All right, guys. I'm live. It's Ricken and you're on the Ricken channel today. And today we're talking all about probates. Yes, I'm going to show you every which way to pull a probate. I'm going to show you the advantage and disadvantage of each one of them. And I promise you by the end of this live stream, you'll know exactly how the probate process works. And I like to simplify things because I'm really good at marketing and connecting with people. technology with my ADHD, it just takes me a little bit more time. So, it's kind of funny that a guy with ADHD owns a software company, but I do have an entire team behind me. Um, I come up with with the ideas, implement it, and uh I like to test it. So, let's jump into it. So, probates, I have a full confession to make. I absolutely just love probates, man. My greatest deals come from probates and I love them. I actually took a a PPL lead in on Friday night and just as an experiment, um me and Zach decided to cold call I think like five or six of them. We got one connected and after 20 minutes um I was able to send over a contract and I have somebody going by there Wednesday to take a look at the property and put the deal together. And it's not a giant profit, probably about 23 to 26 grand. But remember, 20-minute phone call, learned my craft of wholesaling, and I'm able to make that kind of money. Now, I'm gonna let you know, guys, I love all types of wholesaling leads, but I promise you, if you get a probate, you will have the highest percentage in my opinion of getting the best and most profitable wholesale deal. Now, why are probates so profitable? Let me just sum this up. You're solving a huge problem. It sucks when someone dies and the property cannot be transferred without a court order to get it out of their name. And that's why they have a probate court. The purpose of the probate court is to make sure that the final person's wishes are laid out. And so I want to walk you through today basically how it works. And lawyers try to talk over your head. Honestly, by the end of this, you are going to have such a simplified version of how probates work. And then if you have X leads, I'll show you how to expedite it and pretty much pull any record that you want.
Now, going back to the days I started probates, I sat in a lot of courouses. And honestly, one of the best education you can ever get is going to your probate court in your local county, whichever county you invest in, and just ask them, "How do probates work? What's the process? How do I get access to the files? and how can I continue to receive that information if you can get it straight from the horse's mouth. Because remember this, don't ever forget this. All probate leads come from the probate courts. There's not a magical software that does everything for you. It has to be derived at the courthouse. So, someone has to file a petition and submit a probate. Once that done, that is a public record. Once we have a record on file with the county, you have a lead. The question is, how do we get the dang lead? That's probably why you're watching this. And I want to show you um how that works.

So, by the way, guys, I'm a little bit down. I'm in the um I'm halfway through a uh well, not I'm like day two in a fiveday fast. And it's interesting. I I've done two and three days. I never done five, but sometimes we just got to clean stuff out. I love being pushed, but I still got to work. So, um Okay, so let's get back to it. So, everybody knows how to access the course. You're never going to find a better course than that. So first of all, we got to ask ourselves what information do we need for probates? And I didn't do this in um order of importance because I think all of them are somewhat equal. Some a little bit less more than others. But first and foremost, we have to start with the deceased's name. If you don't know the deceased names, you have to understand it. Um, so you guys are asking about the course. It's inside of freeh wholesaling.com in our school group. You'll see it pps 3.0. You can use the search bar. You can look for it. If you just join, you have to get to, I believe, level three inside of school to get access to the course because I got people that spam. I got people that go in there and steal the course and copy it. I'm going to make people at least work for it for a little bit. But don't worry, the whole thing's copyrighted. Um, every month I have to send out about 70 to 80 letters automated through my lawyer um for cease and desist on it. So, um, you'll see it when it pops up there. Maybe it's level four. I don't know which one it is. So, it's in the classroom section. I appreciate it. Do you guys don't I'm not going to waste my time sharing the screen. It's not that I'm wasting my time. I just don't want to waste your time. I'm I I'm here.
So, first one's deceased name. For obvious reasons, we need to know what their name is to access data to get the property records. Now, once I have the deceased name, the next thing I would really want to know is what? I want the property address of the deceased person. And the reason for it, believe it or not, almost half the people that die in probate do not own real estate. Let me repeat that. Almost half the people in probate courts do not own real estate. They go, "Rick, well, how does that work?" The problem is they own bank accounts, they own stocks, they own bonds, they own cars, they own RVs, they own boats, and anything that has a title. A person who's deceased cannot sign that title over. So, there has to be some sort of court action to take care of that. That is the whole point of the probate process. Dead people cannot sign over deeds and titles. And if you do, it's called fraud and you get in a lot of trouble. And by the way, I come across a lot of it when it comes to these types of deals. The people that try to cheat probate, 99% of them get caught in the title search. So, if that ever pops up, just understanding um that will be there. And um that's why we always do title. So, um, okay, here we go. Let's keep going.
Now, what we need to do is once we find out they have a property address, well, Rick, how do I find that? It's real simple. Just go in your property appraisers records and look it up. So, if I have um uh Anna Smith, I'm going to look it up and see if she owns records. Here's the challenging part. Sometimes it's in other counties that they own it. Like I recently deal with a property that they had properties in New York, New Jersey, and Florida. And I'm going to tell you how we deal with those. And I want you to understand how that's going to work. So, but let's just start with the basics so you understand it. So, first of all, once again, deceased name, find out if they own property. We check, how do we do it? We check the property appraisers records. Now, I'm not training you guys to be a lawyer. I'm not here to give you the legal thing and I'll and I'm definitely not giving you um legal advice.
Now, the next set when we do it is we want to find the petitioner. Now, the petitioner is simply the person that submitted the record to the court. Most probates have a lawyer. And I'm here to tell you, when you find a probate without a law, a lawyer, um, they do a pers or prosay, whatever they call it, nine times out of ten they're usually a train wreck and they need someone like you, the wholesaler, to help them guide it through it. Most people do it without a lawyer, to think they can save money. So, it's about three to $400 in court cost, but most judges do not like cases brought before them in the probate court without an attorney. they just feel like there's not representation for the estate. So, if you ever find someone that's doing it on their own, I'm going to urge you to find a probate lawyer to help you get through it. Now, I already have them. That's the whole benefit of doing our our big plan because you guys honestly you spend the most time vetting and and talking and with your marketing and we would love to do deals with them. But the petitioner is basically the person that files. Now can the petitioner be the beneficiary as well? Yes. Nine times out of 10 that's usually how it works out. So, if you understand that, in my opinion, usually if you know who the petitioner is, you know who's driving the probate and quite often the petitioner is going to be the representative for the estate. We're going to go in that in a little bit more detail, but I like to know who the petitioner is because I want to know who all the parties are. Now, the petitioner is usually spelled out in the court dockets. Remember, there's 3,300 counties. They're all a little bit different and states are very different and I don't want to get in the details of it because then I start becoming a lawyer and that's not my expertise.
So if we understand that the next thing which this is the absolute most critical once you get all these is we want to find the executive or the PR which is also known as the personal representative. Once again these words are interchangeable. They have slightly different definitions depending on what state you're in, but for simplicity purposes, it's the same thing. I don't know why lawyers and courts and judges try to It just depends on when it was derived in the English language. Um because a lot of this comes over from hundreds and hundreds of years of law. So, a lot of uh predications already set on this. So, I'm looking for the PR. And just so you understand this, this is the person who has full authority to act on behalf of the interest of the estate. What do I mean by that? Once they're authenticated with the probate courts, which is the whole purpose of opening up a probate um petition, it gives them the authorization to do what? They can sign a purchase and sales agreement. They can authorize listing the property. They can authorize doing repairs on the property and technically they can authorize once they have the pro uh the court's approval what name the deed gets transferred into. Period. This is the person that you are going to be marketing to. You're not marketing to the heirs. You're not marketing the beneficiaries. You're technically not marketing to the petitioner. You're always marketing to the PR or the executive. That's the one grain of salt you got to take from me today. You know why? Because I market it to every one of them. The only person that really matters is the personal representative andor executive. Period.
Now, quite often that's the same person as the petitioner and quite often they're a beneficiary as well. So, what I want to do now is go through and explain these these ridiculous definitions because every lawyer that's ever explained it to me tries to explain it over my head. Now, with AI, you can figure most of this stuff out on your own, but let me just give you a quick crash course and how it relates to wholesale probates. Number one, beneficiaries. Does anybody know what the beneficiary is? Because this word's tossed around like fruit salad. So as we used to call it kamala salad, but like it gets very convoluted. So a beneficiary is someone who's going to benefit by the appointment of someone that that's basic definition of it. And if you understand that, so basically if you had two children and uh if you had two children and the say the mother passed away, she was a soul surviving then the bene they would be the beneficiary so to speak. But we have to get a little bit more detail because it gets more confusing and I've learned this the hard way. So we have to understand a beneficiary is the best kind to deal with. Why? Because a beneficiary, if you didn't know this, they are named in the will by choice. Meaning the person that owned the property said, "Hey, in their will, these are the beneficiaries." And they spell it out. Now, in the court's eyes, this is what matters the most. end of like this is the guide. So, a beneficiary honestly is usually ironclad and that's not always the case in probates and I'm going to spell it out why and I'm going to show you a little hiccup. You do have to watch out in probates. I've probably got about 10 of them right now sitting in limbo because there's no beneficiary to find. So, what's the next thing we need to know? So, remember beneficiary is by choice. They're spelled out in the will, black and white. Something terrible has to happen to remove them as a beneficiary. Meaning, it have to be fraud, forgery, or have somebody sign under duress. So, once we have beneficiaries set, I know that the deceased had a will in place. And I want you to remember that because when you're talking to people in probate, it makes a tremendous difference if they died with a will or without a will. So, when I hear the word beneficiaries and will, I'm a really, really happy wholesaler because I know there's a path to get this done in a relatively reasonable amount of time. Guys, without a will and without beneficiaries, that is the entire process of a probate court to protect those people because, believe this or not, a good portion of people pass away without a will. And it's a nightmare. It I I can't even like you're you're going to find out. And the problem is the biggest well I'm gonna get into it because I've had this happen to me so many times. So when you hear beneficiaries and will you're rock solid like you're at a good good place. You don't hear that you're going to have some work cut out for you.
Now the next term that gets thrown around a lot in probate is the word heirs. And a lot of you think heirs and beneficiaries are the same thing. They're not. Can they interlace? Absolutely. So think about the easiest way to think about like an heir is think about like oh I always think like the queen of England right she's that they're the heir to the throne what does that mean it basically means it is the bloodline the closest person related to the person that passed away the heirs would get it now here's the difference with heirs remember on a beneficiary they are chosen their named in the will. When it comes to heirs, it's about entitlement. It's about law, not choice. So, here's the difference. I want you guys to understand this. Beneficiaries is by choice by the will. Heirs is by law. It's called intestasy. If I always call it intestate. So if somebody dies without a will, it's called intestate, which is just a fancy law word for there's no will. We got to run it through the courts to um prove up who's the closest blood heirs. So an heir is if you had kids and you were to pass away. If you didn't have a will, long as the kids could prove to your kids, then they would most likely be approved in the probate court. There could be other family members, but it always goes to family first unless it's extreme circumstances. And usually extreme circumstances dictate somebody has a will. This is why guys, it's even important to have a will even if you don't have a lot because the dead can't speak. And I will tell you this, the one thing I've understood in probate is some of the nastiest stuff comes out when people die. Sometimes 50 years of family like arguments um and legacy all gets boiled up into a court hearing and if there's a will it usually snuffs all the stuff. People die without a will. They fight they fight like tooth and nail like their life depends on it. And um unfortunately it's sad but um that's how a lot of families run it. So if you hurt so if somebody dies with a will I didn't put this in there. it's called testate. If they die without a will, it's called intestate. Those are legal terms. I just simply say you got a will or you not have a will. I like to simplify things because it's very easy to mix these words up. And then you get into intestasy law. So, and when we talk about heirs, you talk about like the legal law. If there was no paperwork, show me your son. Show me your daughter. Show me your granddaughter. And then that's how you have to go through a court process. It's expensive. It's time consuming. That's why a will is so much powerful. So guys, if somebody dies with a will when it's in probate, it makes the process much smoother. It gets rid of all the ridiculous court hearings and it gets rid of the family argument. It's very hard to override somebody's will if it's legally and done correctly. my favorite way. Guess what? The 10 I got outstanding right now, they're in test ate, meaning there's no will. And then here's what happens, guys. When there's no will, um, it's a problem. So, when we talk about a will, it's huge. Now, not everybody knows, and usually, just so you know, when somebody writes a will, they leave it with their with a lawyer or a law firm to protect it in case there's a fire or anything like that because the courts are going to ask for a physical copy. You can't I mean you can submit an electronic copy, but if somebody um fights it, it's going to be hard to prove it up because I'm not a lawyer once again, but if you have a physical sign that they can verify a signature and a notary and witnesses, it's almost imp it's ironclad. So, I've been to a lot of court hearings with probates. I'm just here to tell you so you understand the process because one of the first questions I said, um you know, did your husband did you guys have a will? And you have to ask it just nicely. Half the time the volunteer just ask it nicely because if they don't have a will, you have to size up what's going on. Now, as I said, if there's a will, the beneficiaries are spelled out. If they don't have a will, we have to go through their heirs and that's basically intestate and then we have to do intestasy laws and it's expensive and complicated. That's why I don't like doing them. Now, here's the other problems. If they die with a will, it's just easier. Does everybody understand? If you die with a will, it's just easier for everybody. It's easier on the family. It's easier on everybody. So, if you have your parents or your grandparents, go ask them if they have a will because it will squash more family arguments than you can shake a stick at. So, it's important. And most people try not to do it till they're old. You never know what life has in store. Do it sooner than later, even when you don't have a lot of assets because if not, the courts are going to decide it for you. And it doesn't always go in your favor and it's expensive and it's very traumatic for the people involved.
Now, if there's no will, like I said earlier, the courts are going to authenticate the heirs and then this is basically what we call intestate. It just means I don't have a will. I don't know why they just call it I don't have a will. No will. No will is easier. Will, no will. That's how I would do it. Now, and this just so you know, when they're in testate, it just means the deceased passed away without a will. And this is what the probate courts are really there to protect against. And you have to understand that if they died without a will, it's not the easiest process in the world here. So um you have to understand that. So no will it's difficult. Now I'm going to ask I'm um I'm going to I I'm starting the questions as we go through this. So um here's my caveat. Some you do have to underwrite every deal you do in wholesaling like which underwrite is just a fancy word for evaluating. The technical word underwriter is say for banks and insurance companies because they do it for a living in a business. We have to underwrite it to see if we're going to waste our time. So when I say underwriting, it just says, is this worth my time? Now, understanding that, here's where I underwrite a probate. And this is what I want you to understand. If they die without a will and they're telling you there's already a family squabble over it and there's a pending foreclosure and you could clearly establish there's probably more than four errors, I'm probably going to walk away from it. I I just I've had terrible success with them and they can take years. I got one going on three and a half years now. The problem is once there's a foreclosure on it, the bank does not care. They don't care at all. And the only way to stop the process is to either cash out, basically send the bank money or catch up on all the payments on it. Well, most of these properties are years behind on the mortgage. So, if there's 50K in late fees and back payments, and then you got to pay an attorney another five grand, and then someone's got to be mowing the lawn and running the utilities. Guys, I've racked up 50, 60, $70,000 bills, and never got anywhere. So, I've learned my lesson. The number one rule for all wholesalers is what? Minimize your risk, maximize your reward. So, sometimes we have to pay an attorney. I'll talk about that a little bit later. I don't. But for the most part, as a newer wholesaler, I don't want you to pay for the attorney. In fact, it's really up to the PR and or the petitioner to handle that. Remember, the the attorney represents the estate, not you. You're just the buyer. And you have to be careful about that. I'll I'll talk about when you do it. So, the thing is, if they need money for an attorney, which can be five to seven grand on average, um, someone's got to pay the utility, someone's got to mow the lawn because this could take six months to a year. Oh, and then someone's got to make mortgage payments. Oh, and then you got to make up the last 18 months of mortgage payments. Oh, and by the way, if you don't pay that, they're going to foreclose on the house in the next 30 days. Do you see what I'm saying? I'm never can convince like eight heirs to figure this out in 30 days to avoid the foreclosure. And I I promise you, if you convince seven, I'm going to find one in there that will waste your time every time. So, if I see four or more errors and the property's in some sort of foreclosure and it's like close to a year behind, all I can do is make a cash offer for the current value and do a traditional wholesale deal. I just find I don't want to waste my time and money on it. And I've done a lot of them, guys. I'm just telling you. Does everybody understand four or more errors, they die without a will, and it's in foreclosure. If you're going to do it, make sure you're pairing up with someone because you're take someone's going to take a tremendous financial risk. How much of a risk? Between 10 and $50,000 and you're under the court's microscope of an eye. So, I don't like those. So, I just if you're going, "Hey, when am I wasting my time?" I'm telling you, if it's in a foreclosure, especially a year plus, there's four more errors and there's no will, that's three strikes, I'm out, baby. I don't want to waste my time with it. And I want you guys to understand that's the problem with it. So, you can't override the the wholesaler's rule. Minimize risk, maximize reward. If you take a 10 to $50,000 risk on every probate, it's going to get wildly expensive. Now, you're going to make some money on it, but like for the most part, every now So, when do I take risk? I've been doing this for 23 years. So, I just took a $17,000 risk about a year ago and I lost. But what you don't understand, I took nine other risks and I won. So, I probably netted over 250 grand and then I lost 17. It's not a bad day in the park. You guys can't gamble on one. So, I will walk through and show you how to do those deals, but I would just want you to understand if it's in foreclosure, usually a year plus. If it's an early foreclosure, you got a shot. But remember, the bill's mounting. There's no will and there's four most plus errors. Statistically, over the 10 plus year, 12 years I've been doing this, those deals rarely work out for a wholesaler. They might work out in some sort of listing because someone's going to have to overpay for it. Not me. I don't want to do that. So, does everybody understand how that works? If you have any questions, please, you have to underwrite probates and see what you are on the line for.
Now, I love risking less than $5,000 on a probate because if I do 10, I'll have one or two doesn't work out and eight, I hit it out of the park. Remember, probates are my highest profit deal, and they will be your highest profit wholesale deals because they're vacant, they're easy to show, and you got plenty of time to find the highest and best cash buyer for it. So, if you understand that, you can make almost any probate work, but don't take tremendous risks on them because that's not what we want to do. So, my ideal avatar for probate, I'm going to share it with you right now. I share this in my PPS 3.0, know, but there's a will in place with beneficiaries of four or less. Statistically, once you start to get four or more people, that's where there's always one person goes, "We want 800 grand for it." And the other's like, "Dude, get rid of it, man. The the propertyy's rough. Guys made a reasonable offer to move on." And so one piece of cake, two very reasonable, three, h, four or more, I'm not saying I don't do them, but I usually don't make the most money on those because you got four different minds with four different agendas, and you usually have to take a compromise somewhere on price. That's just the truth of how probates work. So in the perfect world, I get a beneficiary in the county that I I market to. They have a will in place, the PR of the executive is named and there's like one or two beneficiaries and it's not in in foreclosure. That is dynamite. And by the way, when they're in foreclosure, if it's not too deep down the pipe, they are the best creative financing deals you can ever take over. Why? Because there's no risk to the PR or the beneficiaries on you taking over that mortgage. Now, you have to follow the rules of the mortgage. And for the record, most mortgages allow for them to be transferred in the event of a probate. Now, how you transfer it, that gets into a little bit of legal waters, and I'm not going to walk you in there, but I'm just telling you this is the one exception that you can't really get busted on because the beneficiaries have the right to take over that mortgage. So, in a perfect world, if you want to do it and you want to comply with the law, as long as you're not violating an FHA or a VA, which there's some seasoning requirements, I'm not going to get into that, but usually they got to live in the property at least a year or two before it can transfer. Not transfer before it can turn into investment property. But the reality is you could put that property in a trust. I'm not giving you a legal advice. I'm just telling what you can do. And as long as that trust was designated by the original beneficiaries, you're covered. Now, there's some other inherent risk with it, but to me, it's the greatest creative financing deals you can do. Why? Because there's little resistance, and they're more than happy for you to do that because there's really no risk to them. I maximize my reward. I minimize my risk. And I also minimize my risk and issues of objections from my PRs and my beneficiaries. It's my absolute favorite. I call it uh what what do I call that in that? Um what is that? We call it PPS gold. It's an entire module in there and I show you.
Now guys, do you understand? You can take over a deceased person's mortgage. And if they're like three to six months behind, it's like a gift from God. So, um I did one of my best deals ever. I'll never forget it. I took over mortgage. Check this out. It was a 15-year mortgage. I didn't know it at the time. I thought it was 30. I took it over. I moved fast because I thought it was a really good deal even at a 30. Check this out. They paid seven years into a 15-year mortgage, which means the last eight years was basically 95% of my payments went towards principal. They didn't care. You know why they didn't care? Because it wasn't their mortgage. They did not. They go just take it over. I'm like, "You sure?" They go, "Yeah." And we assumed the loan, took it over, we gave them a cash out, and um I made deep, deep, deep into the six figures. I wound up keeping it for two or three years and selling it um to the tenant we had in there. And basically, when I sold it, I sold it for around 200 grand. I took over like a $54,000 mortgage. And when I sold it, I almost pocketed $200,000 all from a probate deal. Now, I could have wholesaliled it and made a quick 30 to 40, maybe 50K, but I was patient because I knew it was a good fit. Now, in the beginning, I couldn't identify those, but now I know how to do them. So, if you ever have a deal and you want to like have someone go a little bit deeper, if you have a probate deal, look at the profit centers in there and look what's going to be best for you. And how do I establish what's best for you? Listen, if you're behind on your rent or your mortgage, sell the damn thing or partner up with someone that'll give you some cash upfront and stay in it as an equity partner. I do that all the time. I own about 20 homes across the country and those exact scenarios. Predominantly probates where people passed away and we took over their mortgage. It's my favorite way to do it. You have to get consent. We don't make anybody do anything, but it is a winwinwin for everybody involved. Period. you get a great deal. Uh the beneficiaries get exactly what they want without risking any of their credit or anything on default on a mortgage and the person you wind up selling it gets a great deal because they could not normally get into a property like that. And that's where it's just awesome.
So, let me just check questions here. Um okay, let's keep going because I I want to get to your questions and uh show you how to do this online. So, let's talk about the different types of probates because I never really talk I don't talk a lot about this because this goes down to like the legal avenue, but it's important to understand and now when you hear them, you're like, "Okay, now I understand it." Now, over the years, I had to figure this out the hard way. The best person to figure out how probates work past a probate lawyer is going to be your title company. They do a lot of these and they know exactly what they are. So, let's run through the different types of probates and how you can benefit as a wholesaler from them.
Number one, the formal probate. This is one where the deceased usually has a lot of assets um that exceeds the state's threshold and they are required to do a formal probate. What does that mean? It's just a longer process. Period. Just takes longer. Now, if you go over to freehostelling.com, I show you how to expedite the probate process and actually buy the probate property prior to the probate being completed. That's called priority probates. Makes sense, right? Yes, you can do it. No lawyer will ever tell you how to do it. Only Rick shares that information for you because I learned it the hard way. There is a route to where you can actually do that and it's not a big deal. So, keep that in mind when you do that.
The next one is an informal probate. This is usually where there is a it's not at the maximum threshold, but there's just enough where they have to go through the regular dockets to, you know, go through a call of all the deceased assets and everything like that. This is where most of them, so I don't get a lot of formals because formals, it depends on your state's threshold. Some are 500,000, some are 750, and most people don't have that kind of money. But based on where real estate's going in the last four or five years, these thresholds are probably going to go up because the dollar's gone down so far. Uh, so informal just below it depends on the state's threshold.
Now, a summary probate is my absolute favorite, and it's exactly what it says. It's a quick process that they expedite the probate process. And how does this work? It's simple. If two people own a property together, let's say like husband, wife, or partner, whatever it is, doesn't it depends on what state you're in, I guess, and they have a joint rights of survivorship. I'm not getting the legal terminology. I'm not a lawyer. is those people technically can expedite the probate process, which means they don't have to go through formal. They don't have to go too informal. They do a a summary judgement once the lawyer can prove, hey, this is how they own the property. They've already set it up. Uh, joint tenership with the rights to survivorship. Yes, there's other ones. That's why lawyers sort this out and I don't. they go back and they actually file a motion to pull the property out of probate. So, when you see a a couple that are married, this is quite often a summary judgment, but it is a lead because they have to file a probate and go through the formal probate process. And the summary just allows them to go, "Hey, judge, because of this, they don't have to go through a formal or informal." They sign it off and they get it done really quick. These are about 70 65 70% of the ones I do. They're fast. They're easy. There's no argument about a beneficiary. There's no argument about errors. It just goes to the surviving um spouse period, partner, whatever you want to call it. Simple, right? My favorite. You get a a summary one. And how do I know that? If I'm brand new, I'm just going to rely on my title company. They'll tell me and they'll tell you the questions to ask. Now, if you have a couple that's married, usually been a long time. That's and their names both on the deed and one of them died. Most likely, this is where it's going to wind up unless it's majorly complicated. How is it complicated? Means they have a crapload of assets. But most people, the house is their biggest asset and they want to minimize their cost and the courts don't want to take two years to do a formal probate on someone that owns a $200,000 house. It's just not worth the court's time. And so that's why you have summary judgments when it comes to probates all the time. It's usually a a couple they're both their names on the deed. I know I'm chopping this up, but like I'm not here to give you legal advice. I'm here to teach you how to become a great wholesaler through probates. So if we understand that, you know how to do that.
Now, there's two more we got to talk about. Actually, there's a lot more, but the other ones are such like freaks in nature, it'll it'll never happen. So, if we know that, we have to understand. Let me pull it up here. Um, I'm going to do the ones that actually make sense for you. So, guys, all this stuff is shared in my uh priority probate course inside our free school group. Go to freeh wholesaling.com and you can figure it out um on that one. So, the next one is a supervised. And supervised means that they're going to appoint a uh what's it? A uh so now we get into the legal terminologies. Maybe I got my lawyers on here. Uh a guardian at lum. Basically the court represents a representative. Sometimes you have people with disabilities. Sometimes you have people with special needs. Sometimes there's elderly people that have dementia that don't have any family left. This is where the courts are going to intervene and they're going to appoint a PR or an executive to carry out the final wishes. Uh hopefully they have a will and then their job is to protect the estate to make sure it's done correctly. It happens all the time. I see them all the time. I'm going to be honest with you. These are my least favorite ones. It's not that I'm against them. I'm just telling they usually have to sell them. They have to do multiple appraisal processes. You have to go through the attorneys. They'll only take traditional contracts and I rarely rarely ever do them. So, it's important you understand these terminologies and know how to do it.
Now, the last one's going to an important one because this one is often often overlooked and it's called an auxiliary probate. And what does that mean? It means when the deceased owns multiple properties in multiple states. Now, if their primary residence is in the state of New York, which is common here in Florida, and then they own property down here in Florida, if they open up a probate in New York, you can piggyback on that probate. It's a little bit complicated, but you don't have to open. So, what they're going to do is communicate. They'll still open one up in the state of Florida, but they do it under the anxiliary process. It minimizes some of the expense and the paperwork. And usually the same attorney um if the attorney's in New York, he'll file it in Florida. And the idea is not to open. There's people that own a lot of property all around like the country, if
Not the world. And they have to work with other court systems. So they created this process so you didn't have to duplicate it in every state. And so I've done about three this way. I promise you, you're going to need an attorney if you do it. There's no way around it. You have to work with it and you have to do that.
So, um, if everybody understands that, let me go through this once so quick. Formal, rare, um, because those are usually very, very high-end properties and they're not really good candidates for wholesaling. Informal, we do a lot of those. Uh, informal usually means it's going to take some time because there's some complications to it. A summary is my absolute favorite. They are the fastest. They are clear-cut. There's very, very few times someone's going to argue it. Supervised means somebody does not have the capacity or they do not have family and maybe they're elderly and so they'll appoint a a guardian to represent the estate and they usually want to do appraisals. They usually want realtors involved and I'm not a good candidate. Neither are you. And then auxiliary is if they're doing uh multiple properties in multiple states. Uh and I do I I do those not a ton, but I still do them.
So if everybody understands that, that's all the different definitions of probate. So let me give you a couple little little tips on it and I'm going to walk you through how to do this online easily. Um number one, all probate leads come from the courthouse. So we talk about speed to lead. if you could go in your courthouse and pull probates on a weekly basis. And this is how I started. I used to go twice a week. I was obsessed. And my whole theory was whoever got to the lead first had the the the greatest opportunity. Now, I didn't know what to say to him at the time. I wasn't very good at it. But I will tell you, speed the lead does rule. And as the owner of X leads getting ready to show you how to do this online in 60 seconds, you're never going to replace pulling one from the courthouse because you're going to be ahead of me at least two, if not three weeks.
Now, the challenge with that is the courts, the probate court systems have made it inherently much harder for us wholesalers to get this data. In fact, they're starting to charge us now. They're using privacy laws. It's really changed from the 12 years ago when I started out doing at the court systems. So, I've changed my approach to this. It's not Listen, if you have the ability to pull it in your local courthouse, I think it's worth it. But if you're doing it virtually, I get it. I don't expect you to do it. And that's why we come up with solutions to help fix the problem.
So, if everybody understands that, we have to do this. Okay. How can we do this faster? And I'm about to show you this and show you how to do this. Now, I will tell you this. The biggest problem you usually have with probates is most of you think you have to go through a lawyer to do it. You don't need a lawyer. Listen to me. You don't need a lawyer. The estate needs a lawyer, which is basically the PR. End of story. Every now and then, the beneficiaries have their own lawyer, but it's very rare. The problem is when you get a lawyer is your speed to that lead. Your job is to create an agreement and create a comfort level with the PR, the executive to sign a purchase and sales agreement.
Now, my hint is I would not use a wholesale contract on a probate because lawyers pick them apart. Lawyers think everything has to be complicated and expensive, so you have to hire them. So, when they say, "Hey, can I run this by my lawyer?" when you give them the one page or the page and a half contract, it usually doesn't go well. So, use your state approved realtor's contract. If you don't have one, reach out to your local title company. They'll show you a simple ASIS contract. It does the exact same thing. It's just a pain in the ass. I get it. But I'm just telling you through experience doing hundreds and hundreds of probates. They do not like wholesale contracts. Now, your sellers like them, but more than half of them want an approval of an attorney. And for that reason alone, I'm telling you, I would go that route. And even when you get it signed, the lawyer interjects their two cents, which is always annoying.
Now, if you enter into an agreement with the established, not petitioner, the PR or the executive, if you can straight line and get an agreement and they are the authorized representative, you don't need that lawyer anymore. And I can't tell you, it's the most important thing I can teach you when it comes to probates. Now, more than half the time, you're going to have to involve the lawyer because you don't have a choice because the lawyer represents the estate. But if they're eager to get the property sold, they want certainty, they want to get this thing put to bed, try to get that contract signed.
Now, more at least half the time, you say, "I want to run it by the probate lawyer to make sure it's okay." When I first started doing it, I said, "No, I'm not sending it to them because they're a pain in my ass." You can't do that anymore because you're going to throw up red flags. Go. Listen, I think that's a wise choice. Now, I simply ask them, "Can I get the uh the attorney's contact information?" What I like to do is send them a blank agreement and or this is the second one that I've cultivated over time. It's simple as this. Ready? Anchor your position with the seller before forwarding the contract to the attorney. What do I mean by that? Hammer down price. You're buying it for $250,000. Mr. Seller, you're good with $250,000. We're good, right? Perfect. Get them to agree on it because you are going to need them to defend your price position with the lawyer because most 70% of the lawyers will pick it apart. Number two, let them know that you're okay with the deposit. Deposit opens up to pull title to get a title commitment and our $500 deposit should cover it. I like to do 500 on a probate because I know I have a 50% chance that a lawyer's going to glance at it. They don't like tiny little deposits. They freak out. So, you have to solidify the terms and you better make sure that's an assignable contract.
If you anchor those three points, when the lawyer looks at it, and they usually take a week or two to look at it, they go, "Dorothy, I I cannot uh I listen, um, we're going to have to make some legal changes in the contract, and by the way, about 95% of the lawyers were going to put their two cents in it because it justifies their $500 an hour fee." Number two, they go, "Dorothy, I think that price is a little bit low. You need Dorothy to come back. No, no, no. I spoke to Rick. We absolutely agree on it. That's what we want to sell it for. I already talked to the beneficiaries. We're all in perfect agreement on that. I'm fine with it." Once the lawyer goes, okay, what the lawyer is usually trying to do is run interference. They want to get an appraisal. They want to get listed with the realtor. Why? Because they get paid on both those points. And they feel the longer that the probate processes drags out, the more they can build. You don't believe me? I've called multiple lawyers to the table on this. Like really bad stuff. I've seen probates cost $30,000 that should cost two or $3,000. I'm not here to rag on lawyers. I'm just telling you they will do whatever benefits them first. End of story.
And so if you understand that, if you'll sign that agreement, you'll anchor that agreement with them. And if they won't sign, they go, "I want to run it by the law." I said, "Dorothy, I just want to make sure we're okay on the price and the terms. Can we just review it? Because I'm fine with the lawyer looking at the legal jargon and if we have to change some of it up, but this is what we're going to marry to. Period. And if you stick to that, the lawyer goes, "Crap, this guy like has already like convinced her that's what No, I didn't convince her. It's what we agreed on." And remember, a lawyer's job is not to negotiate real estate. They can do that in in a litigation hearing or like some sort of pressing court thing. But a true market is represented between a buyer and a seller. And if you know that, you can make that happen. So everybody understand that that's how it works.
Now, so how do we do this faster? I've already told you speed is critical when it comes to probates. And if you guys saw our launch on Thursday, we introduced a new filter. Now here's the crazy part. This is the part that just like blows me away. We've made this filter available to all X leads user, guys. You can't get this filter anywhere else. At least to my knowledge. Someone will knock me off, but um so this is valuable if you're doing any type of virtual wholesaling or anything like that because now you can just go out and do it. So, let me go ahead and uh Trey, by the way, Lacy, yes, you could go back and the replays on Thursday. Um, let me get this off the screen here and let me show you. Let me pull up my screen. So, when you go inside your X Leads account, you're signed in like this. We have an entire training support um in there that will uh really cool. It'll give you all the little icons there. Um we're still fixing one or two of them. We just had some snafus because you guys overloaded us with it. But if I want to go in and I want to find probates, let's just do this under 60 seconds. Let's test it out. I'm going to click my leads button. Yeah, I think I think I'm in the right one. Let's see. Yeah. Okay. So, you click your leads button. And let's just do this. I'll do a local area. We'll do uh Broward County. And I just show you how powerful this is. So, what I'm going to do is go over to my filters here. And there's two ways to do this. The easiest way is click lean info. You see how it rolls it up there? You're going to drop down here. and you click on this. It doesn't matter if you have a basic plan. You're going to click deceased probates. Oh, wow. Okay. Now, I'm gonna take condos out because in South Florida, they just don't work right now. And then I want you to look at this, guys. There is 2,394 leads. So, what if you want to get the freshest data possible? What I can do is go on here. Say I just want to do this for the month of August. So I'll do August 1st to today's date. Watch the 18th. And that gives me 29 leads right here. Now I took out the condos because I didn't want them. And that's 29 leads that you can work. Pictures, all the information. Some of them are MLS. And then you can go back on the filters. You can search on market offmarket. You know, I like offmarket a lot better. And you can find any county you want and sit there and do that. And guys, how long did that take me to do? It didn't it didn't even take 60 seconds.
Now, is it perfect? No. Remember, we aggregate data, but this is expensive for us to do. And I want you to keep in mind with your Exad's account, we made this free. We didn't charge any more. In fact, I think we had a price reduction for the pro plan and the X plan and we gave you so much more. So guys, if you want to pull probates, I'm telling you, you can do it. Now, it's not as fast if you can go down to the courthouse, and I implore all of you to do that. And that's what we want to do. But I'm just telling you, it works, and I love it.

You have to do A2P compliance. And you got to figure out how to integrate your phone and your website. If you don't do that, you're going to miss out on most of the benefits of AI.

Um, we are working on the spreadsheet. I was told I made it too complicated and um maybe it's a little bit of my ADHD, but remember I've been doing this 23 years. So, we're going to simplify it. We're actually working on a program inside of X Leads to build this all inside the system. So, everything we're doing going forward is going to be integrated into X Leads because we want one platform where you can train, learn, and become the best wholesaler you can. So, I agree with Cordell and I am working on that now. The problem is every time I come up with them, it's too complicated. We have to simplify it. Plus, we're looking for integrations on your campaigns inside of your XLES account so you don't have to copy and paste everything. That's the challenge um of it when we do that.
So, um, so, uh, JT on that, I'm just telling you the dispo portion of X leads, they save you hundreds of hours, hundreds of hours. Now, you have to have the pro or the Xplan to do it, but like for the cost of that, most of you guys buy a dispo service separately and you don't get the leads integration, you don't get the automation. Remember, you get e- signing, you get everything else. I mean, this thing's endless. It's absolutely crazy what you can do. Um, Allan says, "How do we find the phone number of the probate of the air?" X leads. That simple. You just skip trace them. Once you have the address and everything, you can skip trace it. You should not have a problem inside X leads. And you can do unlimited as many as you want.
So, uh, let's see here. Please help regarding JV contracts. recently got sent a deal from a wholesaler who has a deal with their friend. Um I will the person who now brings the buyer what contract should I use? So if you go inside of freeh wholesaling.com go look up um it's called JV contract. Now here's the cool part. Once you have all the information in there, it will automatically create it automatically creates the JV agreement for you and automatically uploads it and e-signs it to your partner and we'll send it to your title company. So, two ways once again on that. You can do it inside your XLES account if you have one. All you have to do is go down to dealboard and you go under JVS and everything's automated. Now you have to enter in the contact information and then you have to add the opportunity. Go through an onboarding call, learn how to do the process and when you get JV deals instead of you panicking and not knowing which paperwork to do. I've done this. This right here in Xlead solves the whole equation for you because now everything's automated. So we get it through. We put an underwriting. could have score. If you move it through, it creates a JV agreement automatically sets up the e-ign. Then you set up the inspection and then you do the final assignment to your title company um and your buyer. And this is why I love about it. And guys, you can do we do uh PPL with it, the whole nine yards. It's crazy what you can do with this.

Connect with people, motivated sellers, offmarket, direct to seller that need to sell. Master marketing. Get five deals under your belt. Get the first one first. Then, and how do we do that? Guys, we are the number one source on chat GPT for wholesaling because we institute it in our entire technology. And listen, you're not going to beat these multi-billion dollars, if not trillion dollar industries. So, I'm not going to try to invent I love when people say, "Oh, I figured out AI on my own." No, everyone uses some sort of engine. So, I like Grock. I like the Musk version, but uh chat GBD is hard to beat right now. and we'll have to see. There's a lot of others, don't get me wrong, but um we understand that.
So, um Sergio says, "Hey, Rick, in the training you mentioned that we stick to one county at a time, different rules each county. Should we stick to that starting out or expand?" Listen, get the one that you're most comfortable with. If you can do one in your backyard, that's always going to be my recommendation. And then you can start spreading out. The problem is before we've had X leads, if you had to go to every county to pull the leads, you either you had to pay someone or had to have a really good friend and it was hard to get past three or four counties. Now you can pull the almost the entire country. You're still going to have challenges. Remember, all real estate's local and don't forget that. So if you understand that, start with one, get the process going and be extremely consistent, then add another one. And once you get consistency, you're going to add another one. But it's like juggling balls. You got to keep it going. I find actually with the um deceased uh probate filter, some of you guys, like we were doing this in Riverside and we actually went out to Riverside and we had to pull a dollar per record. So, we were going through hundreds and hundreds of dollars. Now, inside X Leads, we have access to those records. Don't ask me how. I can't tell you, but we have access. And if it saves you, great. It's not 100% perfect, but damn well near close to it. So, um, start with one and build it from there. Make it like a muscle.

Especially without food, man. It's like it's so interesting like how what we think we need in life and what we don't. And a lot of people go, "Man, Rick, you know, five days eating is extreme." It's not. We eat way too much. And so it just it's about a reset. It's never about weight loss with me. It's about a reset and get riding anything bad in your body. But you guys can take the same. You can do a fiveday fast on wholesaling. I would start with freeh wholesaling.com and then I'd go get an exleads um account. Um um I show you. So, it's not going to tell you if there's a like some of the dockets will tell you, but that's a court decision and they always don't make it like public, but it's once you get a hold of the uh of the um the PR, it's usually black and white. Like they'll like it's not a big mystery. Um and once you get really good at probates, you'll be able to read them and you can kind of tell pretty quickly. Remember, most people they understand they file for probate without a will. It's usually going to be uh a time consuming, if not expensive process. So, um uh but I So, let's see this. So, uh Roio says, "Hey, Rick, I'm trying to get to the probate list. I tried getting the list online, but I couldn't do it. I asked the lady in the front desk that way I can get access to it." So, you're better off um using honey to uh make the bees happy. And I know that's a boy, that's my ADHD kicking him fully, but um geez, the the reality of it is um you get what's the saying? Somebody help me out in the comments here. You get more flies with honey than a swat stick. That's what I'm saying. You got to be really nice to the probate. the these are local people in your community that are working for the government. It's not easy. It's just gotten harder because so many people try to monetize the list. And so we founded X leads to access the online records. So if you want you can you can try X leads. Don't get X leads just to get the probate list. Like you're going to need more help than that. Um but it is one of the benefits of having an X leads count. Hopefully that will help you out with them. But keep going back and trying because there you go. The vinegar. Yeah, that's one I was looking at. Yeah. Um, more you get you get Wait a minute. You get more bees with honey. Wait, wait a minute. I You get more See, this is where ADHD throws me off. I'm talking about bees, honey, and vinegar. And I got no business talking about it. What I'm trying to say is you're better off being polite to people and just keep responding and regurgitating the question to get a different answer. Um, and I'm not 100% in all the probate courts. I promise you. And it's, listen, I'm the first to admit 12 years of doing probates because remember, I've been doing this 23 years. I've waited halfway in my journey to even start probates because I didn't know how to do them. And that's what will take a lot of you out. You always got to wait till you be expert. Don't wait till you're an expert because it takes a long time to get there. The reality is it's harder to get probates. It is public information, but they hide behind the privacy policies. And for that reason, one of the reasons we created X lead so we can get access to somebody's list. Trust me, I'm working on every other list I can get. It the problem is scaling it to over 3,300 counties. It takes millions of dollars to get access to this stuff.
