So, what is a 508c1A? A 508c1A is an exemption code created by the IRS. Unbeknownst to most people today, section 508c1A was specifically added to the Internal Revenue Code to protect the First Amendment rights of churches and other qualified religious organizations, and reflects the constitutional principle of separation of church and state, granting these organizations freedom from undue government oversight, and ensuring their operations remain private and mission focused.
The organizations that fall under this mandatory exception are churches. They're integrated auxiliaries or religious faith-based organizations and conventions or associations of churches. Thus, a 501c3 nonprofit is a special type of 501c3 tax-exempt organization that does not have to report its income or activities to the IRS by filing annual tax returns. The exemption code enjoys a mandatory exception from all the restrictions a 501c3 has, including free speech restrictions, IRS reporting requirements, rules, and regulations from the IRS.
The 508C1A is applicable in all 50 states and recognized internationally under the HEG convention of the United Nations Charter since its inception in 1954 with the Johnson Amendment. The 501c3 has been promoted and advertised by many as the only option to organizing a religious or not-for-profit organization. This is fatally incorrect. Federal law, IRS publications, and court cases all confirm and establish the rights and protection of the 508C1A entity.
