Good afternoon. Happy holiday. I'm Brian Manning. I'm an asylum lawyer and I'm here to answer your questions about winning asylum in the United States. Hello.
Uh, we're streaming live here on Tik Tok, LinkedIn, Facebook, Instagram. Uh, Instagram channel is new in English, by the way. We've had Spanish for a while, but we just got English. Uh, if you want to check us out on Instagram, if that's your preferred platform, uh, search for asylum lawyer. The the name is actually asylum_awyer on Instagram.
Good afternoon, YouTube. How are you? Say hello. Let me know where you guys are watching from. Hello. Hello. Good afternoon. Uh, for those who just joined, I'm Brian Manning. I'm an asylum lawyer and this is the Asylum Answers show where I'm gonna answer your questions about asylum in the United States. That's what we're here to talk about.
Hey, good to see you. Tik Tok, good afternoon. Instagram. Juan, thanks for being here. Dr. um Slowin Fall, sorry for mispronouncing that. Lola Kasco Praash Bash PK Tik Tok cool kid 29. Uh, thanks for being here. Good afternoon on Tik Tok. Good afternoon LinkedIn, YouTube, Facebook, Instagram. Uh, let me know what questions you have. But first, before you start dropping those questions in the chat, say hello. Let me know where you're watching from. Love to see where this community is at of asylum seekers and the people supporting them. Um, because I know a lot of you are asylum seekers. A lot of you have asylum applications pending, but then some of you are looking for information, looking for support for someone that you care about, a family member, uh, a friend, someone in your community that that you're trying to help with asylum. You've come to the right place because I'm here to answer your questions about winning asylum in America.
All right, let's go. We got Aisha Jam says, "Hi over on Tik Tok." PK Tik Tok says, "Hello, New Orleans." Nice. New Orleans, the Big Easy. Cool. Very cool city. Very culturally unique city. When people are visiting the United States from other countries, I often and they're like, "Hey, Brian, where what city should I go to?" New Orleans is usually among the ones I recommend because it's so different culturally than other cities in the United States. It's definitely got its own flavor to it, right? Its own culture, which is super cool. Um, Praash says Seattle. Nice. Um, how asylum seekers who are in appeal can get married to someone outside of USA. Uh, there's nothing stopping you, Aisha, from getting married. It's just that you are not going to be able to bring them here unless you win your appeal and win your asylum case.
All right. All right. Uh, nice. Nice. Is the government still approving asylum work permits? I'm wants to know on TikTok. Yeah. Yeah, we're getting them every day pretty much for our clients. Yep, for sure. Um, by the way, speaking of getting approvals, um, I posted a short on, you know, Tik Tok, YouTube, etc. Um, the other day on on Friday, I think it was about the approvals that we're getting. We are getting approvals. Last week on one day, it was either Tuesday or Wednesday. We got four approval notices in one day. Okay? Then we got like two the next day and then we got like three the next day. We're getting approvals, guys. It is still possible to win asylum. We're winning cases still. Okay? We are still winning cases. I know it may seem like, oh my gosh, with all the news that you're hearing about all the immigration enforcement action, all the problems, all the attempts to make life as miserable as possible for immigrants, it may seem like it's hopeless, like you have no chance of winning your Assam case, but I'm telling you, you do. Okay? We keep winning cases. We're going to keep winning cases. It's true that it's harder. The approval rate is going down. Make no mistake about that. The approval rate is going down. And I fully believe it's going to keep going down with every single month that passes that it's going to get harder and harder to win asylum. Um, but it's still possible. And look, the fact that it's only going to get harder and harder, uh, means that if your case has been pending for several years, you should consider suing the government to force your interview. So you have that interview now in the coming months rather than waiting a year, two, three, four years before you finally get your interview possibly organically uh when it's probably going to be a lot harder. The approval is probably going to be much lower in two years from now. So look, if you've been waiting for several years, we should talk about forcing your interview through with a mandamus lawsuit. Okay? The lawsuit where we sue the government, we force them to give you an interview. All right?
Um, that's that's what I wanted to say to start. Let me know in the comments where you're watching from. Say hello. Let me know where you're joining us from today. And I want to know where you're at and and what questions you have about winning asylum.
All right. Over on Tik Tok. No, sorry. Let's go to YouTube. We got on YouTube. We got Bissy Legacy says, "Good afternoon from LA." I'm coming out to LA. Uh, I'm going to be at a court hearing for one of our clients in Santa Ana, just right next to LA on Thursday afternoon. And then I'm going down taking the Amtrak down to San Diego for a work conference uh in San Diego. I'm excited. I haven't been to California in a in a little while. It's been like a year or something. I think I love California. Love it. Uh, Tigstu says, "Hello." Hey, Tigist. Good to see you. Thanks for being on here. Izzy says, "Good afternoon from In Indiana." Nice. Indiana. Very cool. Uh, we got Kum Dog says, "Hi, Brian." And Arbor, Michigan with best regards. Good to see you on here, Karum. I know that I I mean I know you've been on here a lot recently. I've been seeing your name. Uh, and I know we've been communicating through this through lives, but did you schedule a consultation? I feel like I might have seen your name on the on our calendar of consultations. Uh, I hope so. Oh my. Um, Florida says, "Mogisaga." Nice. Is daga. Is that what does that mean? Is that like Dagistan or what does is Daga mean? Um, hi from Seattle says Ana Mandria, where are you? Where are you from originally? I'm curious because our friend Mog up above is a Russian speaker. Um, we've got Jesse from France. Jesse Jacob says, "Nice." Uh, Dela Stewart says, "Hi from Texas." Dela, where you at in Texas? What part? Uh, hi attorney from Maryland, says Salan or Kalanini. Nice. Maryland. Cool. I like it. Dagistan. Yep. Says Dagistan says, uh, Magdog. Um, nice.
How much do you charge for only the mandamus lawsuit? How much to sue the government? Uh, is what? Li. There's my my attempt again at French. Uh, which I know is not good. Sorry. It's on my list. It's on my list of languages to study. I really want to I'm going to answer that. What you asked mandamus. Yeah, I'm going to answer that. Okay. So, look. So, the question is this. How much do we charge to sue the government? We're talking about a mandamus lawsuit here, right? Where you sue the government to force them to finally give you your asylum interview. If you want our help with just that, it's $6,500. If you want our help with that, plus actually helping you to try to win your underlying asylum case and and representing you, taking over your asylum case from here on out and and doing the paperwork and the preparation and the representation plus the mandamus lawsuit, then it's $12,000. Okay? So, 6,500 for just the mandamus by itself. But if you want the mandamus plus the actual representation in the underlying asylum case, then it's $12,000. But in both of those scenarios, we have payment plans available. You don't have to pay all that at one time. That's how it works. All right.
How can I contact you, please? Uh, go I'm going to put it on the screen. The best way is to go to this web page to schedule a consultation. winasylum.com. Was as yum.com. I'm going to put it in the chat as well. Consultations. Winasylum.com. Um, winasylum.com. Go to cons go to winasylum.com. That's where you can schedule a consultation. All right. Uh, hi officer. I'm from New Jersey. Nice, says Ain Bkari. Uh, nice. New Jersey. What? Uh, let's see. Do you Dallas Stewart wants to know, do you take cases related to I485? Um, good question. And the question is this. So, does my law firm take on green card cases? Well, a very limited subset of them. We help people apply for the green card, but only where it's based off of asylum, which is to say, so someone came and they want asylum, um, and now they're they want to get the green card, they want to get permanent residency. We help people go from the asylum status to green card. Yes. But we don't do green cards based on marriage. We don't do green cards based on employment or investment or anything else other than asylum because we're we're just focused on asylum. That's what we That's what we I think we know really well. That's what we're focused on. We're laser focused on asylum. And so we we don't stray far from that really. Green cards for asyles is really the only thing we do that's not straight up asylum. Okay. We're an asylum law firm. That's what we do. All right.
Uh, we've got uh oh Rosi original originally says uh uh Peter Burgu um or Bergia can't remember if it's in in Russian. Uh studied in St. Petersburg a few times. I love Russia. Uh, not without its problems but um there's some there's a lot to admire, a lot to like about it. Uh, oh, Adella is in Dallas, the Big D. Nice. What's the difference between UK and USA for asylum seekers? Uh, well, our laws will be a little bit different. They'll be similar because they're based on the same United Nations Convention having to do with refugees, but it's different. So, if you want to seek asylum in the UK, I I recommend that you talk with the UK asylum lawyer. All right. Okay.
Karum was uh I won my case. I'm still watching because every time I'm learning new things. Thanks so much. You're great. Oh, very awesome. Congratulations and thank you. All right. What do you want to know? Let me know in the comments. What do you want to know about winning asylum in the United States? Uh, okay. Oh, wow. U BC Legacy says, "Uh, Brian, I had my interview on September 30th. It was four and a half hours long. She told me to come back in two weeks. Tomorrow, I'll find out if I'm granted or denied. Your YouTube videos were super helpful. Thanks." Oh, awesome. BC. Yeah, I remember you saying a few weeks ago that you that your interview was like the next day or something or it was coming up very very shortly. I remember you saying, um, wow. So, tomorrow you go back to to pick up to get your decision. All right, man. All right. Uh, uh, good luck. Or I shouldn't have said man, BC. I don't know whether you're a man or woman. Good luck. Good luck tomorrow. Jump back on the next live. uh BC please and let me know the decision and thank you for mentioning that the YouTube uh videos were helpful friends over on um Tik Tok, LinkedIn, Facebook, Instagram. YouTube is where I've got all my best stuff. Okay. I've got some extremely detailed uh trainings and um tutorials over on YouTube. That's where I've got all my best stuff. Go to YouTube if you want the best stuff on YouTube. Just search for political asylum lawyers. That's the name of my law firm, but it's also the name of our YouTube channel, Political Asylum Lawyers.
Hey, uh, Juan um, on Instagram. Hey, greetings from Tampa Bay. Nice. Tampa. Tampa Bay is the favorite football team of one of my sons, the Buccaneers. He loves them. Um, I have a lot of clients in Tampa. Lot of Venezuelanos. Juan Venezuelan. Juano Instagram in espanol. All right. What do you want to know about winning asylum?
Hello. Hello. Um, current approval rate for Ethiopians. Believe. Uh, I don't know. Uh, off the top of my head, but we've won these cases. We won one. We won an Ethiopia case last week. We got an approval for one last week. We know these cases well. We've helped a lot of people with this. Uh, so we would love to hear from you. If you uh if you think you might want to help, let us know. All right. Go to win asylum.com. was.com. Oh, nice. Leonardo says uh uh thank you so much for all you do. I'm your client and super recommend your services. Ah, very nice. Thank you for being a client. We know that. Look, this is a huge decision, guys. who you decide to hire to be your asylum lawyer is a massive decision with massive implications. Okay. Um, so thank you for choosing us. Thank you for your confidence, your faith in us. We're going to do everything in our power to give you the best possible chance of winning your case of securing your future in America through asylum. That's what we want to do. Thank you, Leonardo. Um, Leonardo says um, uh, does short notice list really work? Is it worth it? Thank you very much. Um, yeah, there's no downside. Look, yeah, the question the question is, uh, this, what is the asylum short list and can it help you? So, look at the Assam offices from time to time they will open up what's called a short list where if you tell them, "Hey, I want to get put on the short list. Uh, they may call you for an interview at short notice." That's what it means for short list. So, like if your if your case is backed up in the queue and they're not going to call you probably for a long time. You can ask if they have a short list open at the moment, you can ask to be put on it. And what happens is when they have people who call in and say, "Oh, I'm gonna have to cancel my interview five day next week. I can't come next week. I have a something going on. I have to cancel." Well, when that spot opens up for like a week from now, they go to the short list and they look at the person at the top and they call them and say, "Hey, we just got an opening for 5 days from now or a week from now. Can you do it? Let us know by the end of the day today. Um, if you don't come back and say yes by the end of today, we're going to offer the spot to someone else to the next person in the short list. The next person, next person, next person." And so you can get called off of the short list and get your interview quicker that way. Does it does it work? Sometimes every once in a while. You shouldn't count on it. I mean, if you really want to get your interview sooner rather than later, the best thing to do is sue the government. But there there's definitely no damage. There's no harm in getting put on the short list. Except you got to be ready to go because sometimes you get that call with just a few days notice. So you got to have all your documentation in order. Hopefully, you got an asylum lawyer who's ready to do your practice sessions, your preparation with you immediately because you might have to go and and you might get to go and do your interview right away. Uh, all right. Uh, Jesse Jacob says, "I have an upcoming interview." Nice. Jesse, where is it? When is it and where is it? What assomoth is is it and when is it? I'd be curious to know. Uh, all right. Um, nice. Uh, uh, Dr. Chester John Pasco wants to know, can you sh on Facebook, can you shed some light on the one-year B bar? Is it re is it really based on your first or last arrival in the US? Thank you. Okay, so the question is this. So, what's the one-year filing deadline? How does it work? from your most recent arrival into the United States or your your last arrival, your most the most recent time from now that you came into the United States, you got to file during your during one year during within one year of that most recent arrival. And if you don't, you won't get asylum unless you qualify for an exception. There's two categories of exceptions. One's called extraordinary circumstances exceptions and the other is called changed circumstances exceptions. And these are complicated. Uh, it's a it's a tricky area of the law and but people do qualify for them. Okay? So it's not impossible to win asylum despite that you've been here for more than a year at the time you apply. But if you've been here for more than a year at the time you apply or you're thinking about applying after being here for a year or more, then I really think you should talk with an asylum lawyer because this is a tricky area of law. You got to handle it very carefully and expertly to win asylum. All right, doctor. I hope that helps.
Uh, we're still waiting for an interview with an officer. Fetlano says, "We're going to move to another state. Will this increase the wait time?" Good. Uh, question. And, uh, the question is, um, this, will moving and having your asylum case transferred from one asylum office to another increase your wait time? Will it mess up the timing? Look, there's no way to tell um exactly what the impact is going to be of moving from one asylum office to another. you just you you you can't predict that. I would say if you want to move, move. Do not do not um do not like decide, oh, I'm not going to do it because it might make me end up waiting longer. It's it's not necessarily the case that it will. There's no way to predict this. So, I would say if you want to move, move. Don't let this keep you from moving. this fact that you know there's no way to predict um what the implications may be for the timing should not should not have any impact at all on your decision to move in my opinion. All right. Uh uh nice. Thanks for your help. You're welcome. My pleasure. Abdul Malik says, "Hey, Brian, do I have to pay for a consultation fee if I'm if I'm coming for asylum prep?" Good question. Actually, yeah. The question is um is this. So what's the first step if you think you might want our help to prepare for your asylum interview? So right now we're talking about a special service that we we just recently started offering called the mock asylum interview experience. This is the preparation. So sometimes you know look the in my opinion the best thing to do is hire us for your entire case. Hire us to represent you as your lawyers from the beginning to the very end of your case. But look, that's not always possible. It's not realistic because of various factors, including often money, right? Well, something that we're offering now is just preparation, which is the most important thing. That's more important than what you say in your application. It's more important than what you say in a declaration. It's more important than your evidence. It's more important than having a lawyer write a a legal brief. It's more important than even having a lawyer with you representing you on the day of your interview. The practice that you do, the preparation for your interview is the most important thing. And we're now offering this as a standalone service. You can read all about it at asylum.com. That's a special web page that I put together that's dedicated just to this service, this service called the experience, the mock asylum interview experience for short, the experience. All right. And um the first step is a consultation. We do we are requiring right now a consultation to be able to hire us for that because not everyone qualifies. So to, you know, go to asylumprep.com, watch the video at the top or read the text below, and if you think it sounds like it might be something that could help you, click on the little blue button to go schedule a consultation so we can talk with you and see if you qualify for this service and tell you all about it and get to know you and understand your case and tell you how we think we can help you. All right, asylum prep.com. Check that out. Uh, okay. Dr. Chester says, "Uh, can't wait to speak with your team member on Friday for consultation." Nice. So, you're already signed up. Uh, Dr. Chester is already signed up for a consultation this Friday. Awesome. Uh, anyone else? For everyone else, if you want to do what Dr. Chester John Pasco on Facebook did and talk with one of my team members about, you know, what's going on or whether we think we can help you, then go to uh winam.com wsym.com. Um, John says, "I would really love to get you get uh prepped for my upcoming interview. I'm just waiting for the notice in the mail." Okay, so you mean you your interview hasn't been scheduled yet? Okay, got it. Look, yeah, we can still we can still Look, if your interview hasn't been scheduled, we can do the prep, but we can do more than the prep. We have time. It means we have time to do more if you want to do more. All right? uh we can help you with the documents and we can represent you during the interview if uh if it hasn't been scheduled yet because that means we've got time. Uh but if you just want the prep, yeah, we can just do the prep now. Um, and you can still benefit from that. Doesn't matter whether your interview is two weeks from now, two months from now, or two years from now because through the practice sessions that we do in our preparation service, we we we record them. And you're going to get access to both the video recording and the audio recordings of both practice sessions. And so you can keep benefiting from that up until the moment of your interview. Doesn't matter whether your interview is a year from now, five years from now, 10 years from now. You can keep benefiting from that up until that time of your interview. So um it does make sense to do the prep now. Even if you don't have an interview scheduled, it still makes sense. I think it's what you should do. All right. All right. All right. Oh, it has been scheduled. John says, "Okay." Or Dr. Chester. John Pasco says, "Uh, cool. When is it, John?" Uh, when is it and where is it? What what office? I be I'm just just out of curiosity. Uh, all right. Uh, um, all right. Ain Bkari says, "Just just a question. Would love you to be our lawyer in our case because we've done we paid the consultation with your office after my interview but spoken with someone else." Um, good question. And the question is this. So, if you hire my law firm, are you going to work directly with me? And the answer is no. Almost certainly not. Look, you don't you don't want me to be the guy that's actually representing you. Why? I'm not the best one to do it. I went out and I hired people that I think are better than me when it comes to preparing you for your interviewer or court hearing and who are better than me when it comes to actually advocating for you, representing you, and like thinking on their feet uh under the stressful circumstances of an interview or a hearing. I hired people who are better than me at that. Look, I like to think that I'm good when it comes to the overall strategy and the framework for like how to pursue an asylum case. And that's what my law firm is built on. And that's what that's the system that we run. It's my system for how to pursue and win an asylum case. So all my attorneys in my law firm, they're running on my system. I've trained them on that. But I think they're better than me when it when it comes to actually preparing you and representing you. And so you're going to be in great hands with them. And so no, I I don't I like very rarely do any kind of um any kind of client work. Honestly, you probably won't even talk with me um during the representation, but you're going to be in great hands with my team. Okay? All right. Look, go to if if you're if you have doubts, go to goo Google political asylum lawyers Manning and and you'll see like our Google business page and look at our reviews. We've got several hundred reviews, a 4.9 star average, and you'll see that it's not just me people are talking about. You'll see them listing names of various people in my law firm from receptionists, legal assistants, parillegals, and other attorneys that people have had a great experience with that that have helped people win asylum. You're going to you're going to see that people love working with my team is what I'm saying. All right. All right. Uh uh thanks a lot. We'll do. I know that you have to become an attorney in a particular state. You have to pass that state's bar exam. How is it you can practice all over the country in all 50 states? BC wants legacy wants because it's federal law. Immigration is a is a federal law uh subject and practice area. It's not it's not done at the state level. That's how so and for immigration a lawyer who is a member of the state bar in any state can do immigration law in every state. There's other areas like this that are federal in nature like US bankruptcy law. Um, what else? There's other ones I can't remember right now, but there there's other ones, but immigration is one of them where if you're a lawyer licensed to practice in any US state, you can do immigration law in all of the states. That's how it works. Which is great because look, you as a as an asylum seeker, you get the whole country to choose from. You're not you're not confined to selecting just among immigration lawyers in your particular state where you live. You get the whole country. You have more options. you have more options, which is a good thing. All right.
Uh, Roman Vorosko wants to know, "How would you recommend to explain if I still feel afraid to return back to my country after 10 years of being here?" Um, look, you gotta you just gota you have you need to think about this carefully ahead of time about why it is that you're afraid to return, right? What is it that makes you think, "Yeah, I'm in I'm at risk. I could be in danger." And you have to practice articulating that. You have you need to practice literally practice saying that answer out loud and then practice answering follow-up questions based on it and just explaining all the circumstances based on your past and your history, based on your profile of who you are, based on what's going on in your country of what circumstances are there that indicate that you're at risk. You have to be ready to talk about all those things in detail. And the best way to do that is is practicing, okay? is ideally with an asylum lawyer in a in a mock interview in a practice interview. And we've got a special web page, special service that's exactly that. That's the preparation for the interview. It's at asylum.com is where you can find it. Okay. Go there and uh check it out. asylum.com. Uh uh Okay. You're welcome. Uh Ain Buhari. Where's that name from? Ain Bukari. Where are you from? I'm curious. That That's an interesting name. I'm not I can't place it. I like to I like to think that I'm good at picking out where people are from based on their names, but I can't I can't pin this one down. Ain Bukari, where are you from? Uh, let's see. Um, how should I know that USCs? Okay. Okay. Jorah Mo said uh uh says uh okay so you went to your interview your asylum interview but you submitted it you were trying to submit a document on the day of the interview and they said oh we're going to have to reschedu and then you got a letter that says oh you failed to appear um and your lawyer is now trying to get it rescheduled how should I know that US has reschedled the interview or will I blow off my 45 days? Um, that stinks. That look, this is a reason why I strongly discourage people from rescheduling their interview because this can happen. They can make a mistake and say, "Oh, well, you never showed up uh and and and close your deny you or refer you to immigration court." Um, guys, try not to reschedule your your interview. Okay, this this happens all the time. This has been happening a ton recently because people are getting their interviews with very short notice. They're very surprised because look, most people who have applied for asylum recently have gotten their interview like right away within weeks of applying or they've gotten the notice at least within weeks of applying and this catches them offguard because they're like they thought that they would apply and wait for years. Uh, but no, that's not how it is right now. Most people are getting their interviews right away. And so people are getting caught off guard and they're going, "Oh my gosh, I'm supposed to go in two weeks for my interview. I'm not ready. I don't have my documents ready. I don't have my preparation done. So therefore, I'm going to ask the office to reschedule it to postpone it." Don't do that. Don't do that. Don't do that. It only bad pretty much for the most part, I think bad things will happen. Okay. Um, long story. There's a lot of different things that can happen, but uh the short version is it may fall through the cracks and you might not get it for many months or even years. And I think that the sooner you get your interview, the better your chances for success. You want to have your interview as soon as possible. Okay? Don't don't reschedule your interview, guys. Uh uh Alfredo prediction says, "I tried hard to obtain police records for my arrest, but still no luck. Will this hurt my case?" Um, the the the question is uh well well hold on do you mean you're you got arrested where Alfredo Alfreda in the US or in your home country? Um, you can only get what you can get, right? When you can't get something, the officer may ask about it and say, "Do you have documents related to this?" If you couldn't, you just need to be able to explain why, what efforts you made to get the thing, and why you couldn't get it. Okay? You can win asylum without any evidence whatsoever. You can win with zero evidence. Okay? You just got to be able to explain, have a reasonable explanation for, you know, why you couldn't get the thing. Okay? Uh Fabian Cayro says, "I'm I'm facing political persecution. Can I get asylum in the United States regarding all the laws that recently have been released?" Maybe we'd have to talk through in detail about your situation to see whether we think we're in a position to help you. Okay. Um, and guys, if you want to talk with us, if you're already in the United States and either you're thinking about applying for asylum or you've already applied, now you want help strengthening and improving your case, you can schedule a consultation with us. That's where it all starts. It starts with a consultation. And you schedule that at winasylam.com. was au.com.
Uh Dr. Chester John Pasco says on Facebook, "I wish I'd known about you and your firm four months ago. I paid $5,000 to my lawyer who did nothing but just sent my papers to USCIS. I did everything by myself. I asked if he's going to prep me or represent me during my interview. I'm appalled when he told me I need to pay an additional $1,500." Well, look, we charge a lot more than that. Uh Dr. Chester John Bosco u well I guess if you were to look at our our fees based on like the different milestones in the case, I guess we don't charge much more than that just for the application. Um, but yeah, look, John, um, or Chester, um, yeah, most almost no other immigration lawyers do full-scale preparation. Almost none of them do a full-scale mock interview like we do. We think it's the key. I think based on my experience as a former asylum officer, now an asylum lawyer, I think that the preparation is the most important part of the entire case and the mock interview is the best way to prepare. Um, look, uh, Dr. Chester, yeah, we I'm glad you're I'm glad you're talking with us on Friday because we want to talk through with you the ways we think we might be able to help you. Um, nice. Watching from Syracuse, New York today, upstate New York, says Sashib Sun. Nice. Uh, oh, nice. I attended one of your live videos a few days ago. I already have a lawyer, but follow all your videos. Nice. My interview was on October 1st. I had to pick up my decision on 15th October. All right. Shiv Sun, good luck. Coming up two days from now, right? Two days. Good luck. I hope you win. I hope you get that approval in two days. Uh, good luck. All right. What do you want to know about winning asylum in the United States? Uh, Tik Tok, how are you? For those of you who just recently joined, I'm Brian Manning and I'm an asylum lawyer. My law firm, it's called Political Asylum Lawyers, and we help immigrants all over the country to secure their future in America through asylum. Asylum is what we do all day, every day. All right.
Uh, Amamira says, "I have an asylum interview on October 31st, and I can't afford a lawyer. What should I do on TikTok?" Good. Uh, well, congratulations. I'm glad you have your interview um, so you can win your case, secure your future in America through asylum. The question is this. What should you do if you've got your asylum interview coming up and you can't afford to hire a lawyer to help you? Look, if you have like zero money and you're not going to be able to get any money, uh, go to my YouTube channel, okay? That's the best place I think to prepare. uh watch all the videos you can on my YouTube channel, especially check out the playlist uh under asylum interview. There's some detailed trainings and tutorials. Okay, the YouTube channel is called Political Assil Lawyers, which is the name of my law firm. So, go to YouTube, search political asylum lawyers. Look, you might not have money to pay a lawyer for full-scale representation, but if you can if you can scrge up just a little bit uh through, you know, your own means or or getting help from family or friends, we offer a preparation service that costs a fraction of full-scale representation. If someone wants to hire us to be their lawyers for like their full case, it's like $11,000 to $16,000 depending on circumstances. But you can hire us just to do the preparation. The practice sessions for the interview and the preparation training we do only cost $3,000. So it's much more affordable than, you know, a full-scale lawyer representation. Um, if you want to learn about that, about our preparation service, go to asylum.com. Okay? As yum p.com asylum.com. That's where you can learn all about uh this preparation service. Okay? And there's um some people qualify for like a buy now pay later plan where you literally don't have to pay anything um up to to get started. Um, so go to asylumprep.com and um instead they pay over time uh through like a financing uh situation. Okay? But look, you can learn all about it at asylum.com. Check it out. Um, nice. Okay. Nice. The attitude alchemist says, "Doing the people's work, my brother. Keep it up." I like that. Thank you for the encouragement. Uh, oh, nice. My love over on TikTok says, "I went to my Assam interview and my Assam officer told me that my declaration was really good." Aren't you our client? My love, who are you? Aren't you Aren't you Aren't you one of our clients? I could be mistaken here, but I think you're one of our clients. Let me know, my love, aren't you? Isn't that you? Uh Amomar says, "Just booked a consultation." Nice. He said it like 20 times on TikTok. Thanks, Amomar, for booking a consultation. We look forward to talking with you. Uh, all right. Yeah, I Perry says, "I got the message. We've taken action on your case, but it's been over two weeks and nothing has changed." Yeah, that happens all the time. You can't trust that, honestly. That thing is messed up. The updates are just wrong very often. You can't you can't really put any stock in that, unfortunately. All right. Uh, what's the difference between case pending and decision pending? Uh, hus wants to know, decision pending usually is what it changes to after your interview, meaning you've had your interview, but now the officer needs to make the decision and finalize the case. All right. Uh, nice. Okay. Okay. Uh, user, I don't know what you mean. You said, "I have a J1 waiver based on fair of execution. Does that strengthen my asylum case?" Uh, maybe put that in different words for me. All right. Could someone from Germany or the EU win um asylum? Otico wants to know. Um, good question. The question is this. Can you win asylum in the United States coming from a you know, like a nice rich developed country like Germany or somewhere else in the EU? It's possible. It's really, really hard. The chances for success are extremely low. Look, winning asylum in general in the United States is very hard. Approval rates are very low, but it is possible. Including uh from we've seen people win from like Scandinavia, from places that rank much better than the United States on these, you know, surveys and um rankings of uh things like democracy and transparency and quality of life and all these things. Um, so, it's it's it's hard. It's really hard, but it's not impossible depending on the particular facts and circumstances of your case. Okay? So, if you fear being harmed in your country, it's worth talking about it with an asylum lawyer, no matter where you're from. U all right. After NID is denied, we sent a letter to the super says the president of USCS to review. What's next? Well, so you're talking about it sounds like a motion to re to uh reconsider uh superQ and yeah, the next step is it's wouldn't go to the the head of USCIS, but rather the head of the asylum office in question where your case is. They're going to they're going to look at it eventually and make a decision. It's either going to be a denial of your motion to reconsider or it's going to be that we what it could be is um okay, we're going to send the case to a different officer to reinter you or we're going to send the case back to a different officer to look at the facts and make a decision and it could still be a negative decision or it could be an approval. So, we actually won one of these recently for the first time. It is extremely rare. I I I don't know if anyone I literally don't know of anyone winning one of these except for we won one a few weeks ago. First time ever. Um, I when I was an Assam officer with the government, I didn't even see any lawyers try to do this because it's so rare and so few lawyers know about it that you can even do it. It's just it's almost like the chances are almost zero, okay, to win a motion to reconsider after getting a final asylum denial. But it's not impossible because we did it a few weeks ago. Um, so don't get your hopes up is what I'm trying to say, but I I hope I hope you win. I hope for the best for you. All right. Um, how to know if the Assam officer liked you and the interview went well. Uh, it doesn't really matter. You may come away feeling like they like you, like they may feel they may have been nice and friendly and it may have seemed like it went well and you still get denied. It doesn't really it doesn't it doesn't tell you like, oh, good chance I'm going to win because it seemed like it went well and it seemed like they liked me. Um, I mean, those are good things. It's better than the opposite, right? It's better than the officer being a huge jerk and you feeling like they were interro just grilling you and pointing out inconsistencies. That would be a bad sign. But the fact that it everything seems to go well doesn't isn't necessarily like a oh, you're going to win. Okay. All right.
What do you want to know about winning asylum in America? I want to know. I'm Brian Manning for those who just recently joined. And I'm an asylum lawyer. I used to be an Assam officer with the government, but now as a lawyer, my law firm, it's called Political Assam Lawyers, and we're based in Texas, but it doesn't matter. We help immigrants all over the country. Doesn't matter where you are, all over the country. We help them to secure their future in America through asylum. What do you want to know? Uh uh oh, nice. Sie says, "Sir, I couldn't bring my case to you because I found you a little late, but I'm going to refer to you two boys. Uh, they're from Texas." Nice. Thank you. Thanks for your confidence in us. Uh, send a chief. I appreciate that. Yeah, just send them to have them have them go to winum.com wsy lum.com winom.com to get set up with us. Okay. for a consultation. Um, uh, quadruple a for a conversion to Christianity case. Is it better to gather more evidence first and then apply or apply now and collect more evidence before the interview considering the interview might be soon? That's a good one. Um, depends on how bad you want to get your work permit, how quickly you how important it is to get a work permit quickly. That's one of the driving concerns for most people in terms of, you know, how soon they want to apply. Um, so yeah, uh, I would say probably if you can afford to wait a little bit in terms of the work permit, get at least a little bit of evidence, get some evidence now. Look, start start working on your application now and at the same time be getting evidence, okay? and and yeah, and then apply and and you're going to have at least three weeks uh from the time you apply to till your interview. Okay. Uh well, I should say at least two and a half. Okay? So, you will have a little more time to get a little more evidence, but yeah, it can't hurt to start now while you're in the process of like starting the application form and and coming up with your substantive responses and stuff. Okay. Uh, please. I have a master's hearing next month and I don't have a lawyer yet. What can I do? You should talk with a lawyer. Uh, you should talk with us. Go to win asylum.com. was ylu m.com. winasylum.com. Uh, my name is Roger Franco. What is the What are the chances Green Tiger wants to know? I don't know. We'd have to talk with you in a consultation to tell you whether we think you have an opportunity, a chance to win. Um, uh, oh, nice. Uh, I'm a truck driver and that gave me the opportunity. Nice. Sad. Sadie says, "Sir, I'm a truck driver and that gave me the opportunity to listen to all of your interview related videos, especially the full 1 hour video of the 400 asylum questions." Oh, it's longer than one hour, isn't it? Like three hours? I think it's really long, isn't it? If I if I if I recall correctly. Uh, nice. So, you were on the road, so you had a lot of time to just open up that YouTube uh and uh have the videos playing and listen to them. Nice. I hope I'm glad I hope that helped. Glad to hear it. That's awesome. Uh Amakmari uh Muslim and by from Pakistan, which is religious minority. Can I claim asylum if I've not been harmed? Captain Wasam wants to know. Um, we should talk. We know this case really well. We know that. Just trust me when I say we know this case really well. Go to winsam.com. captain uh with some okay and schedule a consultation. All right. Um, yeah, maybe yeah, you might you might this is a kind of case where there may be a chance to win even without any past harm or threats. Uh, we should talk about this in a consultation. We want to talk with you. Go to winound.com. wyum.com. All right. Uh, unless the sea dries says please do asylum seekers get interview date after getting a work permit or interview are scheduled before. Good question. The question is this. So what's the timeline after you apply for asylum in terms of you know what comes first your interview or getting your work permit? How does it work? The two are kind of independent of each other, right? One doesn't necessarily always
come before the other or after the other. So basically, um, for most people who apply right now, they're getting their interviews right away, within several weeks of applying, within one to to three months usually of applying for most people who apply right now.
Uh, so there's a good chance that if you apply now, you're going to have your interview before you're eligible to apply for your work permit. Because to be eligible to apply for your work permit, you have to wait till you get to 150 days after applying for asylum. So you apply for asylum and then 150 days later you're eligible to apply for your work permit. Okay?
So good chance that you'll have your interview and then if you win you might win asylum before you ever get your work permit interview in which case you can work legally immediately upon getting your asylum approval. If you get a negative decision then from your asylum interview then um if your case gets sent to immigration court because you no longer have immigration legal immigration status at the time that negative decision is made then you'll be in immigration court proceedings. But once you hit those 150 days after having applied for asylum, you'll be eligible to apply for your work permit even though you're in immigration court proceedings. Okay?
But if you get a final denial from USCIS before re before getting a work permit, you won't be able to get the work permit if you get a final denial from USCIS. Okay, but a final denial is different than a referral to immigration court. Kind of tricky, I know.
Is the government shutdown uh affecting uh USCIS? Um, it's not affecting asylum yet that we've seen that we've heard or seen. So, that's good. Uh, are you good?
Are you uh Schnops wants to know, "Are you strong at Russian cases?" Uh, how was that? How was that? Did I have a strong Russian accent? Uh, I think we're good. Yeah. I love uh Eastern Europe. I love I'm a Russophile. I minored in Russian in college. I got a minor in Russian um language. I studied in Russia three times in St. Petersburg all three times. And I've spent time in uh Ukraine and South Central Southeast Europe and other countries. I we know this stuff well. Yeah. All right. I Yeah. I like Russian cases a lot. We should talk. Schedule a consultation, please. winasylum.com wasm.com. winas asylum.com.
Does the officer who I had the interview with decide whether I win my case or not? We have this question on Tik Tok. Uh, good question. The question is this. So, who actually makes the decision in your asylum case? Is it the asylum officer that you did your interview with or is it someone else? Basically, yeah, it's the officer that did your interview. Now, technically, the decision is signed by someone else. It's signed by the supervisor of the officer that did your interview. It's signed by someone who's called a supervisory asylum officer. But really, it's it's basically the officer who interviewed you. They come up with a proposed decision and then their boss has to review it and decide whether it's like legally defensible. As long as there's not like clear legal error, then the supervisor will sign off on it. If the supervisor really disagrees like like big time with the officer who did your interview, uh they might try to convince that officer to change their mind or the supervisor might just reassign the case to someone else to another officer to make the decision that they think will, you know, agree with their way of seeing it. But I mean 99% of the time it is it is the it's coming from the officer who did your interview is the one who makes the decision in practice.
Uh, all right. Uh, Iran wants to know, is it a good idea to apply for a green card after one month of Assam approval in Los Angeles? Yes, sooner the better. I think the sooner the better. Yeah, sooner the better.
Um, Patrick wants to know on Tik Tok, if you failed the USCS interview and they sent you to court, can you do you still have a chance to win? Uh, good question. The question is this. So, what are your chances of winning your asylum case in immigration court after you were referred there by the asylum office? So, you had your asylum interview with USCS and they said, "No, you don't qualify for asylum and they they they put you in deportation proceedings. They send you to court. Take heart, have heart. It's still possible to win." Okay. Actually, good news. Approval rates are actually a little bit higher in immigration court than they are at the Assam office. So, it is pretty common that judges disagree and they say, "No, no, the asylum officer was wrong. You do qualify for asylum and they give you asylum." So, look, it's still not easy. That the approval rates are still very low in immigration court. But, um, there's a chance. Don't give up. The fact that you didn't have success at the asylum office does not mean you can't have success in immigration court. But look, you're you're at risk of receiving a deportation order imminently. This is the danger zone. You've got to take it seriously. So, you got to put together the strongest case possible.
Um, S. Massud says, "Sir, our asylum case has been pending 10 years, but no response." Oh my gosh, we should talk. Pending 10 years. Massud, please schedule a consultation. We want to talk with you about possibly suing the government in a mandamus lawsuit to force them to give you your long delayed interview. All right. Go to go to this website. Go to winom.com. Please schedule a consultation. You're in a very good very good position to force the government uh to give you your interview to adjudicate your case. All right. All right. Let's talk. All right. You're welcome, Patrick. My pleasure.
Are they scheduling Hamdu A wants to know, are they scheduling interviews quickly everywhere? It's been three months. I'm in Dallas, Texas. There's still, yes, all the asylum offices, at all the asylum offices, most people are getting the interview quickly. If you've been waiting three months, there's still a chance. If you get to like four months and you haven't got your interview, then I would say there's a decent chance that yours is one of those cases that has fallen through the cracks such that you probably will not get it for many years, honestly, to be completely blunt and honest with you. Um, but there's still a chance that you might get that interview notice in the next month here or so. Okay. You're welcome. Massud, did you Mass go to win.com. Okay. Please check check it out. Uh, schedule a consultation. We want to talk. All right. Uh, all right. Nice.
Is green card processing quicker in Los Angeles than Virginia? No, they all go to the same place for asyl at least. Uh, so no, it's about the same. It'll be the same. All right.
Uh, as an asyl is it safe to travel domestically? I think with asylum approved. Yeah, I think it's safe to with asylum approved. I think it's safe to travel domestically in the US. Yes. All right.
Uh Johnny Johnny El Sappa says, "Asign case in California, living in another state but now returning. Am I going to be asked about the previous living?" Yes. Yeah. You're going to be they're going to go through your asylum application with you during your interview. And one of the parts of that is your address history for the last five years. So they're going to ask you about every single place you've lived for the last five years. So, yeah, you're going to have to talk about that. And I recommend that you be open and honest. Honesty is the best policy. All right.
U yeah, thanks for the reply. HDU says, "Are you good with Ethiopian cases? I want to switch lawyers." I think we are. We won one. We last week, I can think of a Ethiopia case that we won. We got the approval for last week. Yeah. Look, I um we know these cases from the Horn of Africa. Um we've had success with them. I love helping people from Africa. Spent a fair amount of time on the continent. Not not on the horn. I I want to get up there at some point, but um uh yeah, I love helping people from Africa. So, I hope you schedule a consultation. All right. Go to win asylum.com. Was yo m.com win.com. Let's talk.
Uh Amomar says, "What are the chances of winning asylum in immigration court?" Uh good question. And um question is this. What are the chances for winning asylum in immigration court? Well, we did see stat uh new statistics about this that were published just maybe a few weeks ago or so. Um I believe it was 36% was the national average approval rate for asylum cases. I think it was something like that. So, not good, right? Not not that high, but it's not impossible. All right. All right. It's not impossible. Um, yeah, it's not impossible. We keep winning cases, both the Assam office and in immigration court. Uh, you got to do everything in your power to put together the strongest case possible. I hope you have an Assam lawyer helping you through all aspects of it. Um, but yeah, don't don't lose faith. Don't lose hope. It is still possible to win.
Oh, nice. Hope says, "I highly recommend Brian 100% over on TikTok." Uh, who is that? Hope, are you one of our clients? If you're willing to say your name, that'd be awesome, but if not, that's fine. You can stay anonymous, but thank you. In any event, thank you for the recommendation. I appreciate that. Very kind of you.
Um, Patrick says, "I called your office and somebody else responded. I'd like to talk to you on the phone and plan." Um, yeah, I don't I don't answer the phone. We have a we have receptionists that answer the phone. And if you do if Patrick, if you want to do a consultation, it won't be with me and I won't be your lawyer. I will not I will not be the person who's personally engaging with you to prepare your case. Our lawyers use my framework. They use my trainings. I I've constructed how we handle cases. They follow the Manning way of doing it. But it won't be me who does uh who's actually like engaging with you on a, you know, on an ongoing basis and probably at all, honestly. So, but you're in great hands with my team. They're great. Go check out our Google reviews. you'll see that people are uh leaving all kinds of nice comments and praise for all my team. Um, you're gonna love them. All right. All right. Nice.
Uh what happens if I miss the interview for a good reason? What's the next step? L M O1982. Uh, I was born in 1982 also, which makes me 43 in case you're to to to so that you don't have to do the math. Um, the question is this. What do you do if you miss your asylum interview? So, you just, you know, for whatever reason, maybe maybe you forgot about it. Maybe you didn't know about it, but then you find out later you missed it, or maybe you you knew about it, but you had a good reason. You had an emergency come up. You need to reach out immediately as soon as possible to the asylum office and ask them to reschedule it. If you had, you know, an emergency or some kind of good excuse as to why you couldn't be there, do try to provide evidence. You should do that by um by email, I would say, and physical mail. I would do it both. When you send the request to reschedule, I would also call um but yeah, I mean, the point is you need to reach out immediately and ask for them to reschedu. And usually they do. Usually they give you like a second chance. Even if you don't have a good excuse, usually they give you a second chance. So, but you need to ask as soon as possible.
Oh, nice. Omar says, "My case is in Minnesota immigration court, but I don't have a lawyer and I booked a consultation." Awesome. I went to law school in Minnesota. I I love Minnesota. It's a good state. Um, we've had a lot of cases there. We've helped a lot of people there. All right. Uh, nice. All right.
If I tr if I apply for a travel document, will it delay a pending I485? No, no, no. Those two things are independent of each other. I don't I don't see any reason why it would delay your green card case. I wouldn't worry about that.
Look guys, if you um want to do everything possible to maximize your chances for a sound success, then I want you to I I invite you to focus on where you can get the biggest return for your investment in terms of your time, your effort, and your money. And that is the preparation. Okay, the practice and preparation that you will do for your asylum case is the most important part. It's more important than what you say in your application. The preparation is more important than what you say in a declaration. The preparation is more important than your evidence. The preparation is more important than the legal brief that I hope your lawyer is writing for you. The preparation is more important than country conditions information. The preparation is more important than having a lawyer represent you during your interview. Even that, okay, the practice, the preparation is the most important thing. And if you had to pick one area to focus your efforts and to to direct your money, this is where you should direct it. I believe I strongly believe this. I strongly believe this based on my experience both as a former asylum officer and now as an asylum lawyer. The preparation is key. And we are now offering a special standalone service. That's just the preparation. Look, I think you should hire us for the whole thing. I think you should hire us from beginning to end. I think that's the best way to maximize your chances for success, but that's not an option for everyone for various reason. We get that. I wanted to come up with something that could help people for a lot lower fee uh and and on a quicker basis in case for some of you that have their interviews coming scheduled already and coming up and we need to move super quickly. This is what we can do. We can do the preparation. We also do it for people that don't even have their interview scheduled yet. Okay? Doesn't matter whether you have the interview scheduled or not. This is the most important thing you can do. asylumprep.com. Go to asylumprep.com if you want to learn all about our uh asylum interview preparation services. Asylum prep.com is where you can find out all about that. Okay, check out asylum prep. Asylum Prep.com.
