Is really important that if we're going to ask voters to give us the power to add new government functions, we have to prove that government can function in the first place. Exactly. And reporting out this book with Ezra was really interesting. And I'll be honest, at sometimes almost black pilling, like it did not make me a libertarian. I I'm I'm I'm still a proud liberal. I believe in an aggressive, muscular government. But it was astonishing sometimes to see that these examples of government failure were not exceptions to a rule, but in some cases something tragically close to the rule itself. And I wonder if you've had a similar experience of coming into government, coming closer to government functions and recognizing that some things just don't work the way they should. Can you can you put some meat on those bones of what you've seen that's made you so passionate about not just announcing new public functions, but proving public excellence?

You know, I I very much agree and I think what's what's been frustrating is that even the very language of this conversation, language around bureaucracy, efficiency, waste, even quality of life, we've allowed this language to be seen as if it is of a right-wing concern when in fact this should be the most paramount left-wing concern because it is either the fulfillment or the betrayal of that which motivates so much of our politics. But I feel like when Turkey um after the Ottoman Empire collapsed, when Turkey wanted to make a country, Turkey basically said, "Let's just kill every single person that isn't part of our group and then we're going to make our own kind of like ethnostate country explicitly." And then they like did that for like millions of people. Um the Armenians and the Greeks being the two largest crowds of people. Holy [ __ ] It's a lot of [ __ ] people. Like a lot of people, like millions of people for the Armenians and then I think over a million I think for the Greek expulsions and then nobody actually really gives a [ __ ] Nobody really cares. I don't know. I don't think Turkey actually acknowledges it as a as any like genocidal war crime or anything. I think it's only like 30 some countries. Um, it's actually wild. [ __ ] you if you think this language was actually what people used to some extent to determine ethnic groups because that's what the Turks apparently thought as well where for the Turkish people it was if you spoke Turkish also this is another thing as I'm trying to chew through Turkish is just a language also I didn't know this Turkish is not like an ethnic group or whatever as well I just assume that I guess maybe it could be a nationality too but if you spoke Turkish back then people thought that languages were the best way to like approximate your history and that was how they determined like which peoples were who so which is which is strange I Never would have ever imagined that. So just always be aware of that when somebody's saying they ended slavery this year. They ended slavery this way. Well, these people ended slavery. You know, somebody said Arab slavery was much worse. Um different just there were different I don't even know if I would even strictly compare them. There were aspects of American slavery that were uniquely crazy horrible. Um and there were aspects of other types of slavery that were horrible as well. For the if you're talking about like the Arab stuff where they would like castrate the little boys sometimes and keep them as other people like that's pretty [ __ ] Um, I do believe I think that America was the only country to do like wholesale chatt slavery. Like when you're born black, you're a slave. You will grow up, have a family, they will all be slaves, and then you will die a slave and then they will do like that form of slavery, I think, was uniquely American, which is kind of crazy. Um, because nobody else I don't think like people had other forms of like indentured servitude or like being taken as a slave after a war you would lose. Um but the idea of like wholesale racially based cattle slavery I think was a uniquely um American thing. Also this is I know enough history now to always know that statements like this are never true. Okay. At Destiny the Greek expulsions happened after Greece invaded Turkey to annex the Greek majority parts of the country into Greece. There's I have not studied yet a single thing in history where the invasions are like wholly one-sided with no justification or no back and forth or nothing else going on. I feel like there's I feel like history is very messy and there's always some back and forth [ __ ] Not to say that what you're saying is strictly wrong. One where those who toil in the night. Also, listen. Okay. As tempting as it is sometimes, okay? It's fun to be unhinched by everybody. Uh, we looked up on stream the globalize the inifat thing. I heard this over and over again and until I looked it up, my assumption was that he said, "We need to globalize the inifat." I don't believe he ever said that. I think people were asking him about like would you defend that statement or something or how do you feel about it? And then he did the [ __ ] pro Paly meandering thing, but I don't think it was him saying like we need to globalize the Iniva. That's what I whenever time I read like headlines or when I read people saying this, that's what I was led to believe. And I don't believe um I don't believe that was ever the case. Night can enjoy the fruits of their labor in the day where hard work is repaid with a stable life. Yeah, we watched it. It was on the bull work where Tim Miller asked him about it. Yeah. Where child care doesn't cost more than and where public safety keeps us truly safe. So, what's your take on Zoron? Zoron, Zoe, Zo, Zoron, right? He seems to have said a lot of cringe around 2020 and control [ __ ] but some of his more recent comments trying to appeal to Neo [ __ ] libs like us seems good. He supports single-stair housing reform, easier to build housing, smaller lots, expansion buildings. Um I mean like my take on this is basically going to be the same um as any further left candidate. Like Magga has a huge problem with authoritarian rule right now. I don't think we haven't seen that with any left-leaning people. So the idea of him trying to rule like a dictator I don't think can

happen. So if there's like a crazy far-left policy, I would say the same thing about him as I did about Kla Harris. I just don't think it'll come to pass. Like I was never ever for a microcond; I was never ever worried about Kamala or Biden doing like a wealth tax, cuz it would be a disaster, and I know it's never going to happen. Like I'm not even—I know that as soon as they would even float the idea, every adviser they had would be like, "Hey, this is actually [ __ ] retire," like, "Oh, [ __ ] Okay, we're not—we'll just stop talking about that."

Um, so I doubt that like this guy is going to [ __ ] destroy New York with far-left policies, you know, as far as like uh boosted rent control and [ __ ] Like in my opinion, all of those types of um or or like the government grocery stores. Uh, in my opinion, those policies are dog [ __ ] I think they're horrible, and I think it would only make things worse. But there's like—there's two things that can happen. Okay, so one—well, there's three things that can happen. One is he just doesn't get the support in the government to do it; two is that he does it, and then he um, you know, it's a [ __ ] miserable failure, and you're like, "Okay, well, look, at least we know this [ __ ] doesn't work"; or three, he does it, and it actually ends up being somewhat successful, and then that's just more data, right? I used to think that um UBI was kind of like a dog [ __ ] concept, but I feel like most of the data that's come out about UBI and places that have tried it—I think most of the data is actually pretty positive. Like it doesn't fully disincentivize people from ever working, and they don't ever get jobs and they just sit at home all day and smoke weed—that that apparently wasn't the outcome I think in any of the places where they tested UBI.

So, you know, um, personally, I think most of the policy stuff is further to the left—is further to the left of me, but I mean, hey, I mean, it's just more data or information to collect, see what happens. Worst-case scenario, government waste a little bit of money for a while. You try something, you see it doesn't work, and then you move on to the next thing. Uh, rent controls obviously [ __ ] are against the public stores thing. Um, just the government getting involved in setting like strict price controls is always very scary because you can kill a lot of your businesses very quickly or kill entire sectors of the economy very quickly like that. So you have to be careful. But again, it's just New York, so it's where the mayor will use their power to reject Donald Trump's fascism. At what point does authoritarians cross the line of which lethal resistance is justified? Um, in the United States, never. Uh, anything they—they ever said about the Second Amendment being to fight against tyranny was a [ __ ] lie. The reality is—the actual reality is it's going to probably be like if somebody's starving, like you have to get to the point where basic needs aren't being met, which is actually a take I've had for a long time. will use their power to reject Donald Trump's fascism to stop mass ICE agents from deporting our neighbors and to govern our city as a model for the Democratic party.

How much power does the New York mayor actually have compared to the city council? My understanding is the New York mayor is one of the most prestigious positions in the United States. I don't know if it would be unfair for me to say I feel like the New York mayor position is more prestigious than the New York governor position and is more prestigious than most Congress positions. Like even being a senator, New York mayor is a—is a really big—that's a really big office in the United States. Um, yeah, the New York mayor, especially post-9/11, is just—that's a huge office in the US. But maybe that'll—maybe it'll recede post-9/11. We don't care about it as much or something. But u—I mean, it's a huge city. It's a very, very, very international city. Everybody in the world that you know comes to the United States wants to see New York City, the Big Apple. There's a lot of diplomatic stuff that happens there and everything. So it's just a huge—Yeah, it's a big city, huge economy. This—a lot of history. Anyone that self-identifies as socialist—never heard of socialist concerns me. I mean, I should. It's pretty cringe. But I mean, hey, listen. He won his election. I think—I think it's foregone at this point, right? Um, the Dems need to learn how to campaign, I think, better. Running Cuomo was a choice. What was Zohan's—uh, or Zo—I'm sorry, I need to stop saying this. What was Zohran's position on the Luigi killing? I don't know. Don't make me look it up because he's probably going to think it was based, even though that's like an obviously super crazy cringe thing.

You think progressives will be less incentivized to vote for Dems now that they've seen one of their candidates win? Yes. Remember the far-left progressives and the socialist communists—no matter what—are not part of the party. Okay. Um, if Cuomo would have won, all of them would be baby raging right now and would be saying like, "Oh no, like I'm not going to vote or I'm going to protest vote or [ __ ] this." None of it matters. Uh, since their candidate won, they're going to vote in the general's forum. But um, I mean, just don't—just you just have to—you just have to phase them out. Just don't listen to them. Don't listen to them. New York City would be the 12th largest economy in the world if it were a country. That's crazy. I heard that your mom would be the 140th largest country in the world if she were a country because of how fat she is.

Do you think the words socialist and capitalist have different meanings between Gen Z and then—and Gen X? Kind of, but it's gotten really cringe because Gen X and above, socialist and communist were like the Soviets. It was like whatever that meant. And then like Gen X to millennialish, like in that time era, communists and socialists just became people who want to do things with the government. Like Obama was called a communist all the [ __ ] time. Um, and then I guess maybe as a result of that or other factors, Gen Z started to be like, "Oh, socialism is actually cool, you know, because we want socialized healthcare." But then now a lot of the young people—at least online—want to be actually socialist. Not just the government does stuff, but like we abolish capital. So, who knows? We need proportional representation to destroy the two-party system. This constant infighting for how the party should act or is defined really feels ineffective. No, people just need to keep their eye on the prize. People need to keep their eye on the prize, and you just have to—everybody needs to be on the same page for that.

Um, my guess is going to be—I haven't dug a lot into the policies of either because I'm not in New York. My guess is going to be I would have preferred uh Cuomo—I probably—or some like establishment Dem because those are just the type of people I like over the Zohran guy. Uh, but if I lived in New York City, I'm showing up all day to vote for Zohran. I'm never considering ever any MAGA alternative. It's not even remotely close to that. You should be able to brutally—brutal as [ __ ] infight when it comes to primaries because that's what primaries are for. But then once the primary is over, then you say, "Okay, fighting's over. Off to the general." Um, we kind of used to do that, right? I think Hillary campaigned for Obama. That was a very brutal primary. That was Hillary's election. It was literally, for all the coronation memes, that was it. And then Obama was a [ __ ] nobody. A lit—a literal whal. He came out of nowhere. And then all of a sudden, Hillary lost that primary. And it was insane. Um, same thing with Trump. Everybody hated Trump in the Republican primary. He was making fun of people's wives and calling people [ __ ] [ __ ] Not [ __ ] but basically. And then u—and they all came out and then they endorsed and Phone Bank, right? There's the videos of—of Cruz phone banking for Trump afterwards as well.

Adams and Cuomo may both run as independents in the general. Um, I don't know how the New York elections turn out, but if it is the case, I don't actually even know how I feel about that. I was going to say if it is the case that New Yorkers vote like 90% Dem and then they want to run as an independent, that's fine. Maybe if there's any risk that a Republican could win though, then you say absolutely not. Why the [ __ ] would you even risk that? But also, I still—I don't even know if—I don't even know if they should. Even if—I mean, like, you had your primary. The—So, I ran E1. Like, I mean, that's your—this is your primary. This is what the primary is for. Zohran won the primary, and now you back the candidate—is what you should be doing, right? I'm not Jewish, but ever since October 7th happened and seeing anti-Jew behavior online and stuff like the Washington shooting, I feel like Jews have legit reason to be afraid.

Do you think Zohran would enable more extremists on the far left? I want to support him, but I'm a little hesitant. I don't know if he would enable them. I doubt he's going to do much to curb them, though. Um, I think if you're a Jew, I think anti-semitism should be a pretty spooky thing right now for you. Um, the George Floyd thing had a—had the entire country uh, you know, protesting and rioting for months, and like we're having like Jewish people assassinated now in the United States by clearly anti-semitic and now pro-Palestinian driven people, and actually nobody gives a [ __ ] Nobody cares at all. So that's kind of a spooky world to be in, I think. And you have um a lot of anti-semitism now on the left, and the—the right has a good foundation for anti-semitism um in the far right, although the main party doesn't do the anti-semitic stuff as much yet. But Destiny, they have rank-choice voting. Oh yeah, someone on the seat got mad because I mentioned that um I—I knew friends in Canada who did like—who talked about strategic voting for rank-choice voting, and they were like Canada's rank-choice voting. I think Canada—they must have it for something because I had Canadian friends talking about—I think Canada had rank-choice voting just for the—for the—after Trudeau stepped down or something. I think they had it for like one thing. Lol. Destiny trying so hard to stay middle on this one. I don't—how—how long could you have ever watched my stream, but you think I would try to stay in the middle on literally anything? I don't know why you would ever think that. Yes. Sometimes I wake up and I think, "How can I make the broadest?" There's a lot of things that make New York City special. The broadest amount of people happy credit for as far as article 5 look. It's this just like not even a—it's just like not even remotely a close consideration. Like I would post-date a ballot in case I got murdered to vote for anybody over Eric Adams. Basically love—and the—the heads of these countries get up and the love and the passion that they showed for their country was unbelievable. I've never seen quite anything like it. The—they want to protect their country, and they need the United States, and without the United States it's not going to be the same, and you can ask uh Mark or you can ask any of the people that were there—it was really moving to see it—they love their country; they were so respectful of me because I'm the head of the United States—and it made—you know, the king of Saudi Arabia when I was in—I was in the Middle East—so I was in Qatar for a different reason—not a reason to get shot at. We're in there for economic development reasons. Qatar, UAE, and Saudi Arabia. All three leaders of those countries. And we took back 5.1 trillion dollars into the United States. All three leaders said, "You know, you're presiding over the hottest country in the world. The United States right now is the hottest. Everybody wants to be there. Everybody." Also, not sure if you saw, but the Bronx really did not support Zohran. Do you think Adams has a shot to beat him in the election or is he cooked? Um, I don't know. Not sure, actually. I don't know what the racial breakdown is of New York for who supports who or whatever, but I'm pretty sure Zohran was carried primarily by like wealthy white college and wealthy white um suburb voters, but I mean—not suburb, I shouldn't say suburb, but that—that's what I saw posted online, unless that was a meme, but that's also not surprising. Remember like the socialist views and all that. As much as people try to say like Malcolm X was a socialist and Black people actually love socialism, it's—it's a very white um college kid flavored thing. Not to say whether it's good or bad. That sounds bad. But everybody wants a piece of it. He said, "A year ago, your country was dead. You had a dead head running it. You had a country that was dead." And it was dead. You had people pouring through the borders. It had inflation. You had everything. He said, "You've made it in five months at that time. You've made it the hottest country. This is the hottest country in the world. United States right now is the hottest country in the world." And when I was around that table, it was a nice uh group of people.

Zohran did better with men and Cuomo with women for some reason. I don't want to—I don't know if we went over this stream or not. I don't want to speak out on the Cuomo stuff cuz I haven't researched it too much, but from what I read of the Cuomo stuff, the—the quote-unquote 12-15 sexual harassment things or whatever, it kind of seemed a little meme. Maybe there was really bad stuff in there that I just didn't see, but it seemed kind of like old-person harassment—like called, you know, like was saying like a girl was hot or commented on her breast or whatever while he was in office. And a lot of these like were over the past like 20 years or something. Um, not to say that it's acceptable or good. Obviously, you shouldn't do that, but it felt like when I first read about all that stuff, my assumption for a long time is that he like [ __ ] was like touching on, you know, like 10 or 15 different women, was like trying to finger [ __ ] them or something. But it kind of seemed a little meme. Maybe some of them in there, like I'm—I'm not—I'm being serious. I haven't looked into these. So maybe some of them were really bad. I'm not sure. Many of whom I knew from previous—when I saw the passion they had for the country. Almost everyone—and you probably have the tapes, it was very public—but almost every one of them said, "Thank God for the United States. Without the United States, we couldn't—they couldn't really have NATO. It wouldn't work. It wouldn't work. It will in the future because now they're paying much more money. But uh—it—it wouldn't work." It was great. Oh [ __ ] Are people figuring out how to appeal to Trump? It's just a matter of how do you play the leader now? Um, having a bunch of people going up to Trump and being like, "We can't do this. We're actually—it's impossible without the—the might and glory of the United States. It's been so important for our past. Like you guys are just so great and amazing. There's no way we can survive without you," like—is the way to appeal to his um—his narcissistic side. Jesus. I wonder if there's a—I wonder if there's a world where Ukraine starts like building like Trump launchers for some of their missiles and they start like labeling [ __ ] that way or something. Um, I wonder if uh Trump would feel differently about Ukraine. And I left here differently. I—I left here saying that these people really love their countries. Wow. You basically, you originated the fact that in Europe we now spending when you take it to aggregate 700 billion more on defense than when you came in office in 2016 and 2017. But that was strength, 45. But then when you look at 47, what happened the last couple of weeks is really staggering. The Europeans committing to a package of 800 billion defense spending. The Germans now potentially up to half a trillion extra in defense spending. And then, of course, you had K star here, the British prime minister and others all committing to much higher defense spending. We're not there. We need to do more. But I really want to work together with you in relative to the DH summit to make sure that we will have a NATO which is really reinvigorated under your leadership.

Uh, and we are getting there. We also discuss uh defense production because we need to produce more weaponry. We're not doing enough and not in the US, not in Europe. Um, and we are lacking behind when you compare to the Russians and the Chinese. And you have a huge defense industrial base. Europeans buy four times more here than the other the other way around, which is good because you have a strong defense industry, but we need to do more there to make sure that we are amp up the the production and kill.

Wow. Do you think Zilinski doesn't know how to handle Trump or just has too many things stacked against him?

Um, Zalinsky probably has an issue because Zilinsky lives like a lot of people live in a delusional reality right now. Even people that do politics live in a delus delusional reality. But the last four years have been hard. We've seen the dollar slice go extinct. Storefront after storefront closed and had a mayor in Eric Adams who has ignored the struggles of small businesses. That's why as mayor, I'm going to make it faster, easier, and cheaper for small businesses to get started and stay open. First, we're going to cut fines and fees for small businesses by 50%. Regulations are important, but small businesses have to navigate more than 6,000 of them with far fewer resources than the big chains. That's why as mayor I'll appoint a momand pop zar with the clear goal of making it easier to run a small business. $1,000 isn't a lot to our city government, but it can be make or break for a small business trying to get opinion on him buttoning his top button without a tie. True. Get off the ground. Next, we're going to permit application. The mom and pop star will coordinate with agencies to speed up turnaround times, cut red tape, and let New Yorkers start businesses sooner because you shouldn't have to fill out 24 forms and go through seven agencies to start a barber shop. But most of all, we're putting our money where our mouth is by increasing funding for small business support programs with 500%. We're going to invest $20 million in our business express service teams, which pairs small businesses with a city case manager that helps them navigate permits and regulations, as well as connecting them with programs that provide them with financial and legal assistance. Right now, only 3% of businesses are using these programs. We want that number to skyrocket. The only thing more in New York than an egg and cheese are the small businesses that make them. Together we can not only protect them but encourage new ones to make a home in our city.

Well, we both agreed for starters that corrupt abuse of Andrew Cuomo should not be allowed anywhere near city hall. And we know that by teaming up, a majority of New York New Yorkers won't choose him. At the same time, we have a positive vision. You know, when I first met Sauron, he was leading an effort to help taxi drivers who were under crushing debt. Like several had committed suicide, uh, because medallion holders were crushing them with uh with excess debt. So he led a hunger strike, teamed up with people and designed a $450 million debt relief program and has now built on that with a vision for a city that all New Yorkers can afford whoever they are, and I find it inspiring and so I hope folks will rank me number one on their ballot and ranks around number two.

Mr. Mom and I think you know Brad Brad has been a principled and progressive leader in this city for years. So many of the laws that we celebrate in this city are ones that he actually brought to bear. And I'm talking about someone who founded the progressive caucus in the city council. And it's it's it's exciting to know that while each of us think that we will make the next best mayor of New York City, we also understand that it's time for a politics of the future. And that means a politics of collaboration, a politics of sincerity, a politics of principle.

And well, this race, this race in general, Governor Cuomo being in the race, you guys and the other candidates, this has made national news. You both have been interviewed on on the national news networks. Your opponent Andrew Cuomo has been recently endorsed by Representative Jib Klyber of South Carolina, a guy who, you know, basically clinched it for Biden in 2020. Does that matter?

It's funny. I mean, it does. Like I said, I think New York City mayor is like one of the most prestigious political positions to hold in the United States. But it's just funny that like Clyber's endorsement matters for New York mayor. Why do you think this particular race is has become a countrywide story?

I think in some ways because it's a referendum on where our party goes. What we're talking about is a race that has now seen the most funded super PAC in New York City. The idea of co-endorsing in this rank choice system is weird, but the dynamics of this are interesting. Yeah. I don't know how I feel about it. I don't I just I don't I don't feel like I like the this whole rank choice meme and like the meme voting and the strategic voting and everything. I don't know. Municipal history, a race that is, you know, one that billionaires and corporations want to buy. And this is a tale that we're seeing across this country where it's a battle of organized money versus organized people. And ultimately, it's a question for our own party of how do we move forward? Do we move forward with the same politicians of the past, the same policies of the past that delivered us this present? Or do we move forward with a new generation of leadership? One that is actually looking to serve the despite this being despite this being a New York City race, foreign affairs have become part of it partly because this is such a multicultural city. And so I'll ask the same question to both of you. I'll start with you, Mr. Lander. Does the state of Israel have the right to exist?

Uh, I support the vision of Israel as a Jewish and democratic state.

Mr. Mdani, same question. Does the state of Israel have the right to exist?

Yes, like all nations, I believe it has a right to exist and responsibility also to uphold international law.

Okay, let's talk about the elephant in the room is that there are many people in New York, even people who would support your candidacy otherwise who don't want to support you. What's the downside? I just like people that are trying to like game the voting system or whatever. I don't know. It just seems weird. Or like people that I don't know. It might not be a big issue at the end of the day. I mean, every system has its issues, I guess, because of the Jewish community's fear of the true and rising anti-semitism, not only around the world, but in this country and shamefully in New York, which is the largest Jewish population of any city other than Tel Aviv in the whole world. If you really want to um Mr. Money, same question. Does the state of Israel have the right to exist?

Uh, I support the vision of Israel as a Jewish democratic state.

Mr. Mdani, same question. Does the state of Israel have the right to exist?

Okay. Let's talk about the elephant in the room is that there are many people in New York, even people who would support your candidacy otherwise who don't want to support you because of the Jewish community's fear of the true and rising anti-semitism, not only around the world, but in this country and shamefully in New York, which has the largest Jewish population of any city other than Tel Aviv, in the whole world. And they are worried. They're they're very upset by some of the things that you've said in the past. And they are afraid that your mayorship would actually lead to increased anti-semitism that they believe that that would be more dangerous for them. It's kind of a this question is like a very particular one and the signaling is like very subtle and careful. So like this guy over here would be I don't know if he's a pro-Israel candidate but his answer was a pro-Israel answer. I support when people are asking you if um do you support Israel's right to exist? What they're really asking is is do you support Israel's right to exist as a Jewish protected state? And then this guy's answer was yes. And then Mani's answer was no. But he said it in a in a politically correct way. I mean a way you should. But um I think these two guys were friendly for this election. I feel like I saw a lot of stuff on Reddit and Twitter where people are like, "Oh, make sure you put him second and we'll put him second and all this [ __ ] or whatever."

Yeah. What do you say to those New Yorkers who are afraid that you wouldn't be their mayor, that you wouldn't protect them?

You know, I know where that fear is coming from. It's a fear that is based upon the horrific attacks we've seen in Washington DC in Boulder, Colorado. It's a fear all the way from Jews will not replace us to today. And and it's a fear that I hear also from New Yorkers themselves. You know, just a few days after the horrific war crime of October 7th, a friend of mine told me about how he went to his synagogue for Shabbat services and he heard the door open behind him and a tremor went up his spine as he turned around not knowing who was there and what they meant for him. I spoke to a Jewish man in Williamsburg just months ago who told me that the door he left unlocked for decades is now one that he locks. And ultimately this is because we're seeing a crisis of anti-semitism. And that's why at the heart of my proposal for department of can you explain more on how he said no to that question while literally saying yes because he's asking because the question is should Israel exist as a Jewish majority a Jewish protected state. He said yes every nation has the right to exist as long as they comply with international law. This is like a I don't want to call it a dog whistle, but it's a subtle signal to Israel can exist, but it needs to be one person, one vote with every single person um the people in Gaza and the people in Palestine having the same voting rights, which would mean a Jewish minority state, which is obviously the thing that Israel is trying to avoid. That basically that not basically that's what his answer was signaling of community safety is a commitment to increase funding for anti-hate crime programming by 800%. Because to your That's reading it heavily. Nope. I my read is 100% correct. I know it is for a fact and anybody that has dealt any time with this issue and I'm sure he has like 100% that is that was what he was signaling there. To your to your point, anti-semitism is not simply something that we should talk about. It's something that we have to tackle. We have to make clear there's no room for it in this city, in this country, in this world and and no justifications for violence of any kind. No, there there is there is no room for violence in this city, in this country, in this world. And what I have found also for many New Yorkers is an ability to navigate disagreement. You know, I remember the words of Mayor Cotch who said, "If you agree with me on nine out of 12 issues, vote for me. 12 out of 12, see a psychiatrist." And it's also not very like consequential, though, because it's it's the New York May. He's not making foreign policy decisions for us or anything. So, an older Jewish woman come up to me at Bernay Chesher in a synagogue many months ago after a Democratic club forum and she whispered in my ear, "I disagree with you on one issue." How is that a fair reading of international law? What charter says Israel must become a Jewish minority state? Well, because they would say that the occupation of Palestine and Gaza is illegal and if you live within the b the borders of Israel and if Israel is going to claim to rule this territory, then every single person in that territory should have a vote towards the Israeli leadership. Right. In a synagogue many months ago after a Democratic club forum and she whispered in my ear, I disagree with you on one issue. I'm pretty sure you know which one it is and I agree with you on the others and I'm going to be ranking you on your on my ballot. And I say this because I know there are many New Yorkers with whom I have a disagreement about the Israeli government's policies. And also there are many who understand that that's a disagreement still rooted in shared humanity. Because the conclusions I've come to, they are the conclusions of Israeli historians like Amos Goldberg. They are echoing the words of an Israeli prime minister Ahud Mayor who said just recently what we are doing in Gaza is a war of devastation. It is cruel. It is indiscriminate. It is limitless. It is criminal killing of civilians. These are the conclusions I've come to. I mean, can I sure please? I mean, by the way, before you answer, yeah, before you answer, I want to say if we're not able to fill fit everything in this interview on the broadcast, we will put the whole thing up online unedited. Okay, go ahead.

Um, so look, I'm a proud Jewish New Yorker raising two Jewish kids here is the joy of my life. I'm the highest ranking Jewish elected official in New York City government. I'm nervous about rising anti-semitism and also I believe in the humanity and the human rights of Palestinians. Uh and I know that it is I think that by the international law statement he just means he just meant that Israel shouldn't be committing war crimes and is slightly hinting towards the genocide things. No, it it doesn't have anything to do with the genocide thing. It has to do with the one it's I don't know what else to say is that it is what it is. I don't know what to say. His like this guy gave the clear pro Israel answer. Um he gave the I don't know if I would call it the prop pali answer but kind of that one. Yeah. Possible. Um, I I hate what I I support that vision of Israel as a Jewish and democratic state, but I hate what the Netanyahu government is doing in Gaza. And I've been saying that a long time. And look, you know, that's why this guy keeps saying as a Jewish state, as a Jewish state is going to be responsible for what happens in the Middle East. But there is something quite remarkable about a Jewish New Yorker and a Muslim New Yorker coming together to say, "Here's how we protect all New Yorkers." Jews, people don't understand the actual question. Well, these two guys understood the question. That's why they answered the way that they did. Jewish New Yorkers and Muslim New Yorkers are not going to be divided from each other. We build a city where you have affordable housing and good schools and safe neighborhoods for everyone.

Well, Mr. Mani, how do you I'm just curious, how do you think you'd be the first Muslim mayor of New York. How do you think you could build a a a bridge of understanding between the significant Muslim population here in the city and the significant Jewish population here in the city? How could how do you think you could lower tension?

I think by foregrounding that humanity and and in many ways that's the most New York City thing we can do because for so many of us who've grown up in this city difference is something that we celebrate. It's something that we know is actually a part of the fabric of this place that we call home. And you know many years ago I was the campaign manager of a Jewish candidate for state senate and I took him to a mosque in Bay Ridge and after he gave his speech at Friday prayers an older Palestinian man came over to him and he looked at him and he said cousins. And I think that there is this possibility of building a shared life in our city because ultimately that is the story of New York City. It's a shared life of people from across the world and it's one that we know even in the language of the hostage families themselves. Everyone for everyone. We are tied together as one. Okay. Uh Mr. Lander, uh one of the reasons why why you're here is not just because you're uh doing well in the polls, but last week you were handcuffed by ICE for linking arms. People were calling Clobe racist. Wait, what? What? With an immigrant that they attempted to detain. Um first of all, um why was that important for you to do? And as mayor, what ability we have to resist the federal authorities on immigration policy do you think is abusive?

So, I've been going down to immigration hearings for a few weeks now. About a month ago, Department of Homeland Security changed the rules. It used to be that these folks who are coming, who have done everything, right? They registered at the border. They got a hearing date. They showed up expected to be able to say why they're afraid that if they'll be deported, they'll face violence or persecution back home. About a month ago, started dismissing their cases and saying, "You no longer have status as an asylum seeker." They're like bewildered. They leave the courtroom and a gang of ICE agents not wearing uniforms and wearing masks grab some of them uh and essentially disappear them for deportation. Volunteers have been asked to show up at the court, bear witness, try to give them a little know your rights information to let them know they can object, try to connect them to lawyers. And that's what I was doing here. I met that gentleman, Edgardo, and I just took his arm, tried to walk him out of the building five times before. I've been able to get families walked out of the building so they could go back to their neighborhoods. In this case, you saw they grabbed us, separated us. I was in detention for four hours. Edgardo remains in ice detention today. And and as I said, um uh you're the controller of the city. Um what is that? Fair enough. Everything is under control. What come what? What? What do you do? The chief financial officer in New York City managed the $275 billion pension fund that is retirement security of teachers and cops. So, you're the money guy. Okay. You're the money guy and wait a You're the money guy and he's a Democratic socialist. You're you're a socialist endorsing the money guy and the money guy endorsing the socialist guy. How how do socialism not scare you? Cuz socialism scares a lot of people.

I mean, look, I I am a proud progressive and I think that's in the tradition of New York City. I mean, this is an incredible city. Generate so much creativity and energy and wealth and the job of city government and of the money guy is to invest in the public goods that keep that thriving going and then share opportunity so much better and that's what our schools are and our parks are and our libraries are that's what we're paying for with all those dollars and that's the city we love and I think what what Brad has also shown by being the money guy is holding people accountable one of the main reasons that we know that Elon Musk took $80 million out of the city budget was because that was something that Brad discovered and and I think that and we're going to get it back so and at the core of is about actual accountability because what we have is a federal administration in Washington that is authoritarian in its actions and its vision and we deserve leadership here in New York City that is actually an alternative to it, not something that looks like a mirror image of it.

Well, I want to talk about I want to talk about that and I want I want to get back to what what happened down at at the court is okay. So, it is uh expressing its power in an authoritarian way. This administration Trump has said he's sending troops to New York just like he sent to Los Angeles. What I'll start with you, Mr. Leonard, what can you do as mayor similar to what Karen Bass was faced with in Los Angeles. What can you do if there are troops in the streets of New York to protect New Yorkers?

Yeah, well there's a lot we can do to protect New Yorkers. I'll start with the fact that like I was proud to be there for Edgardo, but you know what would have been better for Edgardo was a lawyer and the city of New York should be paying for legal representation for people who are facing deportation so we could deescalate. And what I was proud of in what happened last week was it's in the nonviolent tradition. We are standing up against authoritarianism and we can do it in a way that is

Nonviolent, that deescalates, that shows the best of New Yorkers and the best of Americans. We are going to need to come up with more tactics for doing that.

Hey Jesse, have you seen or are you planning to watch the Johnny Harris video 1955 versus 2025? It covers and compares housing price and other trends. You might have strong opinions on it. Um, there's like other stuff. I'm in very much like history mode at the moment for my brain. Um, I don't think the Johnny Harris guy does very good research. So, if I watch a video of his, I would have to dive into every claim he makes, and I just don't really feel like doing that right now, especially over that topic.

So, that's peaceful protest. That's bearing witness in the courts. And yes, that's keeping a peaceful city. Even if they send the National Guard here, we will not back down. And we will show what New Yorkers are made of in a peaceful way. We've only got a minute here, and and I got to get a couple of other things here. New York is a big old town, okay? It's old. It's not necessarily machine politics like the Chicago that I used to live in. But it's it's there, a lot of bodies buried. You know, still a lot of machine politics. Okay. And one of the thing, one of the things that people say that, you know, the vote for Cuomo is like, he knows where the bodies are buried. He knows how things are done.

Mich, you're 33 years old. You know, a fresh face is very good. New ideas are very good, but why should the city trust someone with so little governmental, especially executive experience, to run the greatest city on earth? No. I think it's a moment for New Yorkers to ask themselves what kind of experience we want. Because what we see in Andrew Cuomo is the experience of resigning in disgrace, the experience of cutting Medicaid, of cutting hundreds of millions of dollars in funding for the MTA, of offending the more than a dozen women who courageously stepped forward to credibly accuse him of sexual harassment. The experience that I offer is one that I'm very proud of. You know, as Brad was saying earlier, I think of the experience of Richard Chow, a taxi driver who lost his brother to suicide, someone who had been sold a dream by the city as a ticket to the middle class. I organized alongside Richard and thousands of working-class taxi drivers, and we won a half a billion dollars in debt relief that brought so many of these drivers back into the dignity that they've been denied. And alongside that, we won the single largest infusion of money for the MTA's operating service. Better Hodge was saying that Mandami is somewhat abundance pill the other day. I don't know enough about it though. Uh, I don't know if that's really true or not. I'm not fully convinced of that. Um, other than he thinks government should work well, but I think that's a pretty hollow take. Um, but I don't know, subways, better bus service, the first of its kind fair-free bus pilot, a track record of fighting for working-class New Yorkers. And ultimately, in this moment, we can also see a glimpse of how we would run the city and the campaigns that we're running.

Well, for both of you gentlemen, what's your relationship with like unions, with with with police? Those are those are the things that run the city. What's your relationship with police?

Well, look, you know, that's my job as controller. I invest their pension funds, and I'm happy to say last year their pension funds were up 10%. I work closely with representatives. Even as we invest in more affordable housing and uh show how you could run the city well.

All right. How about you? What's your relationship like with the police?

You know, it's a relationship where when I've had conversations with rank-and-file officers who've told me that they joined the police force to tackle serious crimes, I've heard their frustrations that they've instead been asked to play almost every single role that city government can imagine. The same people who thought they were signing up to deal with shootings are instead playing the roles of mental health professionals and social workers. And ultimately, it's part of why we see 200 officers leave the department every single month, with about a quarter considering doing so because we're not letting them do their actual jobs. And that's part of our vision. Let the police do the critical work that they do towards creating public safety. Let's create a department of community safety to have dedicated teams of mental health outreach workers and social workers in our subways responding to homelessness and the mental health crisis.

One of the things, and I know we're going to we're going um, you know, uh people, there's an old saw that says just you know, make sure the potholes are filled. Okay. It's what's going on in everyone's neighborhood. People in New York are distraught because there is the city's dirty. There's rats everywhere. There's moped chaos. It's not the top thing on my list, but also cross. Thanks for the kick, host. You know, what what do you do? A lot of empty storefronts around the city. How do you increase the as mayor? What do you do to restore the city to a sense of uh vitality?

Well, yeah. Well, first you need a well-run city government to deliver the services, to pick up the garbage, to keep the streets clean and safe, to run the schools well. So, first you got to sweep out all the corruption that Eric Adams has brought in because we don't have right now top-flight people running every city agency. Think about what it could be as an answer to Donald Trump. Uh, when the next mayor says, "I want the best and brightest here," running that transportation department, running the sanitation department, and making sure we keep the streets clean, safe, the neighborhoods well-run. I'm glad Eric Adams finally decided it was time to start putting the lids on the trash cans. That's a big step forward. You keep the rats. Uh, we will have a rats. Okay. How do you revitalize the city? How do you keep it clean and safe?

No, I think as someone who cares deeply about public goods and the public sector, we have to care just as much about public excellence. We have to deliver the best quality of life in the city. And as Brad is saying, so much of that concern that many New Yorkers have is tied to a systematic underfunding of city agencies. We're talking about a mayor that we're both seeking to replace, who at one point was proposing removing trash cans from some New York City street corners. And that's part of what makes people feel as if they're living in a city that is dirtier, that is less well-run than the one that they know.

Do we have money for that? We do. We do. Do we have money for that?

Well, look, my number one pledge in this campaign. All right. I'm glad you asked. My number one pledge in this campaign is to end street homelessness for people with serious mental illness. We don't have to be a city that has a couple thousand of our mentally ill neighbors. You know what's expensive? Our hospitals and jails. We will actually save money even as we make our city safer.

Um, if Andrew Cuomo loses the primary, he said he'll run as an independent. If you guys lose, if either of you guys lose, will you run as an independent?

My focus is just on June 24th, and I'm confident that we're going to be able to beat Andrew Cuomo and send him back in the suburbs.

Okay. By we, I know you said we, but it really can only be I because only one person can wrestle.

No, we're arm wrestling. Who's who's winning the primary? I'll ask I'll ask you first. I try to arm wrestle for it right here. I'm in the number one chair now.

I actually wonder if Cuomo would win if he if he ran as an independent because I imagine there are going to be votes that he can sweep up from the Democratic side, and I know Republicans and [ __ ] Muslim New York City mayor that's like a [ __ ] hellscape nightmare to them. I wonder if Republicans would vote for Cuomo. I have no idea though. I don't know what the electoral landscape looks like though. To support your point, here's a time stamp from the mayor debate. Adams is already running as an independent though. He actually is 100%. Homes or the subway platform because ultimately we need to focus on delivering on their concerns. Yes or no? Do you believe in a Jewish state of Israel? What the [ __ ] I believe Israel has a right to exist as a Jewish state. As a state with equal rights to exist. Oh yeah, we might have already watched this. It is funny how much they obsess over the Israel [ __ ] in um in the New York City mayor debate, but this is how they voted. I think the craziest question was like how quickly until you visit Israel once you're elected New York City mayor. And it's like why the [ __ ] is the mayor going to New H to to Israel? What the [ __ ] though? Adam won the election of 66.9%. Oh yeah. Okay. Damn. That could be a Oh, plus Adams too though, right? Has Adams Adams is running? Of course. Oh, never mind. No way. There's no way that Cuomo would win because him and Adams are going to be splitting against each other, right? One of them would have to make the decision to not run. Adams would either have to withdraw or Cuomo would have to endorse Adams. I don't know. I don't even know if that's like in the cards for either of these people. He wouldn't even run. This is embarrassing enough for him. Oh, I thought people were saying he already declared that he was running as an independent son. Unhinged Vos response to a well-informed anti-Zoron DGG-like voter.

What? You read that Adams was 100% running at Cuomo.

Oh, sorry. Oh, my bad. Yeah. Uh, Victoria. Victoria, nice to meet you. And are you from Queens?

Uh, my entire life.

Okay, great. Um, in Jackson Heights?

Uh, in Elmhurst, then Forest Hills and Jackson Heights. So, this area, Western Queens. So, what are your thoughts on the election so far?

Uh, I don't like the way it has shaken out at all. Um, no. I'm worried. Oh, no. Basically, um, I supported Zora Meyer, who was my first choice from the beginning, who I think was absolutely wonderful. And uh, unfortunately, because of the way things are falling, I've had a vote for someone I really, really don't like, but who may save us from someone I really think is wrong for the city.

Okay, we all we all know what she's saying here, right? No supporter of Mandani talks this way. Is this is also a thing I've noticed with I guess you could say like liberals or conservatives or whatever, but anyone who isn't leftists. Nobody on the left ever sounds ashamed of their vote ever. Nobody has ever talked this way voting for Bernie, AOC, Mandani, anything like that, you know.

Yeah. They know they should be ashamed. Comfortable. Yeah. But it's they all they also always vote for people who are losing, but like they're of course they're not ashamed of their vote because they're they're voting literally on social credit and vibes and whatever makes them feel the happiest rather than actually winning elections is what?

Okay. Well, elaborating on that. Yes. My second choice vote was for Andrew Cuomo who I loathe, but I think Zory Mandani is a complete insult to our intelligence and dangerous and horrible.

Okay. In what ways do you think that he's dangerous or what parts do you disagree with?

Ideas are while they sound attractive and I think he is a wonderful wonderful speaker. I honestly do. Um, a lot of them are things that would have to go through the state legislature. A lot of them are things that I didn't want to profile immediately, but she does have evil eyes. So, I feel like that was my thought immediately, but then I thought, come on, chronology isn't real, but it is. Um, she does have evil eyes. So, you could have gone off that like from the beginning. Just don't make any economic sense. $30 minimum wage sounds great, but there are a lot of small businesses you can't go up that quickly that steeply. Freezing rent. I am a renter, but you know, I concede that there are things that the rent guidelines board has to take into consideration. So, I just don't think they're thought through. And I I I kind of I've gotten to think it's like a left-wing version of Trump. It's just break. This is making me think that she's um she's just a bigot because why it's so boring and tired. The Hassan [ __ ] the Taylor Loren [ __ ] I guess Vaj does it too. Still disappointing where like everybody that disagrees with me is a racist, is bigoted, is on the Trump side. I guess it's they're a communist or they have TDS or it's like a race to label your opponent as something and to never ever ever like it's actually crazy too because my guess is going to be this woman is way more politically plugged in uh than an ordinary citizen. I don't know how they're finding this, but like she's giving surprisingly nuanced answers for a person on the street, right? Like, oh, I'm a renter. I don't know about rent control. Some stuff would have to go through the state legislature. The rent control boards have their rationals where they do 30. She's actually giving decently politically informed answers. Way more than I would expect from from a random [ __ ] citizen. But just don't think they're thought through. And I I I kind of I've gotten to I'm sorry. Does she have the Jew archetype? Is this a Jewish person? I can't tell. I'm suck. My Judar is broken. It's like a left-wing version of Trump. It's just break. This is making me think that she's um she's just a bigot because I feel like if her problems were with Mani's policies, she would have spoken more severely about the rent freeze. If she literally brought up two policies and issues relating to them. what she literally brought up the $30 an hour thing and I think that's where she mentioned the state legislature thing would have to be brought in from and then she literally brought up the rent control thing and said that the um rent control boards and she said even as a renter what are you talking about if it's not that then why the [ __ ] are you talking about him so severely that makes me think like there's something else when you say he's not a good fit for New York do you think he'd be a good fit for your neighborhood how many how many things does she have to bring up in 10 seconds in order to not be a bigot what the [ __ ] things for the s for you know just for the sake of breaking things and I really I really find that scary.

So you're kind of mentioning that you feel like you're in a tough situation. You're actually the first voter I've spoken to who had a first choice who was um my uh yeah which is kind of wonderful. I think his housing plan is just you really creative and really what we need. I mean he wants to go in with 100,000 units of housing. I mean I think it's it's just wonderful and you know I think he's been lost in the shuffle. He is young. Uh but you know I think he would have been a great mayor.

You think she lied about the renter thing? Oh, when she was like, "I'm a renter." She in her head, she's like, "Well, I rent stuff out. I rent, you know." I mean, obviously, he's not going to going to go anywhere. But what are your top issues as a New Yorker?

Um, cost of living, healthcare, housing.

Okay. I mean, I guess maybe. Yeah. I don't know. I would say so. In terms of housing, would you like to see like more housing being built? Um, what are some changes that you would like to see?

Uh, I would like I I don't like the city of Yas. I don't think it's sensitive to neighborhoods like this one where historic preservation The city of Yas. Is that what she said? Is that a reference? Uh, I would like I I don't like the city of Yas. I don't think I don't know what that means. It's sensitive to neighborhoods like this one where historic preservation is so important and so much a part of the fabric of the neighborhood. Maybe. Um, I would like I think it was Brad Brad Lander's idea to go to like uh city-owned lots or maybe it was Scott Stringer, I can't remember, but a lot of like vacant city-owned land and she pays a lot of attention too. She knows multiple candidates and multiple positions from those candidates. I like Yeah. And I But I like how you just said that she wasn't giving policy positions. It was just a bigot.

Can you explain pros and cons to rent freeze policies?

Um, rent freeze is um rent freeze is considered bad because it causes people to consume inappropriate levels of housing rather than to sort themselves out in a more financially reasonable way. Um, it encourages overconsumption. If you are in a certain property and you have a rent-frozen property, you're highly incentivized to stay there and not move when moving might be better for a variety of reasons. Otherwise, um, it disincentivizes renovation or units sometimes being created in the city if people know that um or or purchases of of units or whatever. People won't buy stuff or invest in stuff if they know there's not going to be able to um recover any rents on it. Um, and it makes it harder for people outside the city to ever afford or be able to move into the city because the number of unrenrolled units are often times much more strictly controlled or there's a smaller supply I should say. So, the prices on those tend to be even higher because there's more people competing over lesser stuff. Um, the pros on rent the rent control side is that if you have a rent control unit then you are then you obviously there's a huge surplus of value there for you because you are um able to own and consume something uh at a much higher that has a much higher value than what you're paying for it basically and start building there. Um, the idea about building market rates and housing market-rate housing in the um extra areas around housing projects I think is pretty good. Um, so I mean we do need more housing, but I think it has to be done sensitively. I really do. And I really like the plan and this I know is Landers um borrowed from other places where you on on the homeless mentally ill, you get them homes first. You are you are an interesting one. You're an interesting one.

The city of Yasu was a legislative proposal in city council to make it so that more commercial lots can be rezoned for residents and vice versa and increased regular capacity for housing/legalized some basement tenants etc. Okay. Um, okay. Now that my contractual obligations out of the way, did you see you didn't you didn't see that ninth circuit reversing the TTRO in California regarding the National Guard deployment? Um, I think I read a thing on it, but like like I saw I had land on it, but I don't want any of the details about it. Okay. We don't need to get get into the the super fine details on it. But they essentially kind of did the same thing as um the Supreme Court with the American Enemies Act where they say, "Oh, the the president declared there was a insurrection. We can't review that and so therefore the TTRO is going to get um overturned." Okay. And I and I and I want your opinion on how you feel about the president having these kind of statements that they can make that are just entirely beyond judicial view. Do you think that that's something that should exist in our government or like should exist in a good um structure of a government that we have somewhere the president can just kind of say something exists and it's just beyond judicial when you present it that way. No. But I think with the way that it works here, I would say probably yes. U because it sounds like this was expressly granted to him from an act of Congress and they even I think gave their own limitations to it. But I think the Congress has chosen not to enact their own restrictions on the president's um declarations of emergencies and everything here. So I mean like obviously I don't like Trump's declarations here, but it seems like this was literally a law from Congress. Congress even granted themselves some authority to review the presidential declarations and they've decided to forego that. So, I don't know if it would be appropriate for a judge to step in here to try to do that. So, I think it's easy for me to agree with you on the whenever we're talking about like in the moment, we're talking about he declares it, he's deploying, he's taking care of it, right? If there was a true invasion or insurrection, I think it's hard for to make a case that a judge should be able to step in and make some kind of decision. But let's say we are three months past whenever this conflict is this this apparent emergency's over. Mhm. And California shows up and says, "Hey, that was not an insurrection. Here's problems that happened because of his actions, and we have a cause of action now against the the president for doing those wrong things." Who's the who's to say what an insurrection is or not? Well, I think in the moment it it makes sense that we can't because remember the the courts are saying we can't look at the factual allegations behind this in the claim of the insurrection. So if he says there's an insurrection because there's a million people rising up in LA and we've got to go stop him. Yeah. And then 3 months later we say, "Well, wait, there's only a thousand people." Right. And that should not have constituted the response, right? I think at that point whenever the dust is settled, we can come in and we're not talking about in getting in the way of the president's enactment of power, but saying maybe there's liability afterwards for an improper enactment of power. Do you think that there's space for something like that? Um, intuitively, no. It doesn't sound like it. No, because the idea is you wouldn't want the president being worried that a court is going to second guess his um insurrection declaration, right? Well, sure. To me, I see the balance of am I more worried about a president second guessing himself about an insurrection declaration or am I more worried about a president abusing an unimpeachable declaration of insurrection? Like what what are those two things? Which one? So, this is the big this is the big issue that we have right now that I think people need to be very careful about is um like I say that Trump is like a dictator and all this [ __ ] and I say that over and over again, but the issue that we have right now is that Trump did not seize power in a way that was unpopular. Trump has the support of apparently half of American voters right now, and that's where a lot of our issues are coming from. So if you ask me just looking at the American system, am I worried about the president just arbitrarily declaring insurrections and abusing that power? The easy and instantaneous answer is no. I would never be worried about that because we have a very easy mechanism to instantly hold a president accountable for that which is impeachment at the very least if not Congress um using whatever was built into that act to say, "Well, we reviewed this and actually we don't agree there's an insurrection." Because I think they have that on the Alien Enemies Act. Um and I think they have that on the on the other one that he was using for terrorists. I think they have these built in. But the issue is, well, what do you do if half of America supports it and therefore over half of the Congress supports it and then the president does it? Well, I mean, at this point, are we looking for the judiciary to stop it? Probably not. I don't think so. I think Trump has the popular support for this. Congress is our mechanism to stop it, and Congress isn't doing it. They're failing their job or or maybe they're succeeding their job, I guess, depends on how you view it. And so, I think it is as it is. It sucks, but that's Yeah, that's fair. I just in my mind whenever I'm I'm thinking about it kind of in a bit of a macro sense I it feels a little bit like the Congress is creating a power handing it to the president and then saying well the judiciary can't get involved and then whenever we come to this kind of place where we're saying okay well now we need someone to check this the Congress says oh well we're hands off or we haven't put the right measures in there. It's not so much that we're asking somebody to check it. It's that we're asking to get a procedural thing from the judiciary that probably should have been further clarified by the Congress because we're not asking for a check on can he actually do this. We're asking for like a definitional procedural check on was this actually an insurrection. And it sounds like that's something that maybe Congress should have had a stricter definition for that in in the actual piece of legislation or something. But absent that, I mean, it's not I don't think it's up to the judiciary to to check that. I mean, if Trump has the power granted to him from the Congress and they pass that law and they're not doing anything about it, then even even in a a post a a a retrospective case assessing damages from a potential misuse of power, you don't you think even that is too far of a restraint from the because in that case, right, I'm not saying that doesn't remove any of Trump's powers. It would just make it so that a person would be owed um restitution by the government for a misuse of power, right? It this happens in civil rights cases and things like that. And we have cases in which the government abuses power. People then have a cause of action to come in and sue for damages and get paid because the government misabused the powers they were grant. I think those are generally very exceptional cases though, right? It's pretty rare that the government can be held civily liable as long as it's exercising its power. Like those are generally you're talking about where people are stepping outside of like their civil immunity or stepping outside of something and doing something either illegal or or I think generally illegal. So against the law, not necessarily the government just doing a thing. Yeah, sure. But I mean I think I think that in whenever I look at the second amendment of of the United States Constitution, at least spiritually nowadays, the purpose of it is as a literal check on an abuse of power. It feels like we we as a nation have at least in the past, I don't know anymore, a concept of there's an abuse of power by the government and there needs to be a severe check to it. There needs to be something there. And I feel like I agree with you. I I do actually really agree with you that the Congress impeaching the president is is a true check and and does address this. Um however, um the la the the fact that we have these three branches and it feels like the judiciary is being really cut out of a lot of this is a little unsettling me in the sense of in a perfect world where we a post perfect post Trump world in which we're reforming to make sure this never happens again. To me, I see that that is an area where something could be at least done or changed. So, I just I mean, you could rewrite these laws or amend these laws in ways that add some more qualifiers. But the reality is there's probably not much you can do if half the country is willing to support a guy who's actually a dictator and then half the Congress is willing to support a guy who's actually a dictator, which is where we're at right now. I mean, there's what are you going to do, right? I'm I'm Yeah, I'm very I have no argument against the he's just got a at least facially populist mandate to just kind of do whatever he wants.

Um, okay. Then to I feel like we talk too much about politics and and and doomer stuff. I I believe you style yourself as a pretty good debater, right? I try to be. Okay. Um, are and and you can are you confident in your ability to argue positions that you don't personally hold? Yeah, of course. I mean, if it's a if it's related to a topic where I have a position that I do passionately hold, but not for like random stuff that I don't know anything about. Right. Sure. Sure. Sure. Okay. Um, can you help me? I'm trying to work out I'm trying to kind of build out a uh a debate or an argument against veganism. Do you mind being a prove vegan debate partner with me? Sure, we can do it for a couple minutes. Go for it. Yeah, this isn't going to take long. This isn't going to take long. Okay. So what I've seen in the past, so so my argument stems from the idea that there really isn't any moral reason to not eat people, right? Because I feel like what I see a lot of vegans do is they say it's immoral to eat people, but we think it's moral, or at least it's a morally neutral thing to eat animals, and that's wrong. We should consider it immoral to eat animals. Is that a misstatement of That's starting to get there. I mean, I think most vegans would just say that like they would just say that that argument is fine, but then they would say that you're insane because the vast majority of people would never be okay in a world where you can eat other people, right? Well, but we we No,

No, no. We already live in that world. We live in a world where it's okay to eat people. It just has to be the right circumstance, right? You have to be in a situation in which the necessity exists such that it would overcome your empathy for another person. And this is true for other animals, too. We don't eat dogs generally because Wait, wait, wait, wait. What are the circumstances where it's okay to eat people?

If you and I were in a lifeboat, okay, and we had no food and it was probably 30 days to shore and we would probably die if we didn't eat anything and there was a fresh corpse in the boat. I feel like I wouldn't eat that corpse. Sure. So that might be the case, but I feel like I don't feel like this is an actual test of any moral principles because I think if you wanted to, you could like the qualifiers that you're adding there, like you're going to die otherwise, you could basically make anything morally permissible, right? Like, should we be allowed to kill inconvenient 8-year-olds? I would say, well, no. And I was like, "Okay, well, what if you were in a survival situation where there was only three of you, two adults and an 8-year-old, and you only had enough like food to survive for 30 days if you killed one of you?" Like, in that and you need both people to row the boat or whatever, can you kill the 8-year-old? Okay, I guess in this, but like we wouldn't take that moral rule and then say, "Well, I guess it must be okay to kill 8-year-olds in certain circumstances then because the amount of qualifiers you added are so special. You would never generalize that rule to all of society, right?"

Well, one second, but we Okay. In America, we generally don't eat dogs, right? Sure. Is there any moral reason why we don't eat dogs? We like dogs and they're cute. I don't think that's a moral reason. I think that's like an empathetic reason. Most vegans would agree with that, though. Vegans would actually start their arguments there. Have you ever seen videos of cows? Why would you not eat a dog, but you would eat a cow? Cows are just as cute, right? They would start from there.

Yeah. Well, they might say that, but my argument is that it's easier for us to empathize with dogs and cats. They there's even studies on it showing that they share similarities to human children such that it allows us to empathize with them greater than say, uh, other animals. And yeah, but I mean you can also we empathize with people who are more similar to us than not and that's why slavery was possible. That's not a moral argument for slavery. It's not a moral argument for slavery. But the reason that slavery is wrong though I can talk about things like, uh, people should have the right to freedom, people should have the right to liberty and things like that. A corpse doesn't have any of those rights and I'm not violating a human corpse's rights by eating it.

Sure. And I'm not, by the way, I'm not saying we should kill people and eat them. I'm saying just eating a human body. That's all. Not killing and eating a person. Sure. I don't think vegans would be opposed principally to eating an animal corpse. Right. Sure. But so then so Okay. So then it's then the issue is is like why is it okay for so is it more just that the vegans would be arguing it's wrong that we are raising, killing, and then eating the animals? Eating the animals is just a result of the bad action of raising and killing an animal for eating. Yeah. Part of the ecosystem, right? Okay. Okay. So then I've seen also a kind of a name the trait argument kind of thing that they do and they seem to do they rely on consciousness or is that just where it always ends up or they usually use a different thing? Name the trait is going to be the one because a lot of people try to draw a meaningful distinction between animal sentience and human sentience. And the problem is it's hard to create an all-encompassing category that would include every human because people intuitively feel like the category of human is something that should be protected that would exclude every animal because people seem to feel like animals are a category that can be excluded. So name the trait will run down what's every trait necessary to guarantee human privilege that doesn't also apply to some category of animal that we eat. Right? So like and this is just lawyer brain here. Um, for me if I was asked that question it's just that humans can have intent and animals can't. And and I mean that in a legal definition. Um, in the sense that animals can are are considered to not be able to possess intent to actually do things. They have instinct. Although I'd be careful. The counter here and you know this as well, right? Is the reason why children for instance aren't sentenced to capital offenses because they're said not to possess the mental faculty to even have the mens rea to commit, um, like acts that are so horrible that they would be sentenced to death for it. Like a 12-year-old is said in all states to not be able to possess enough state of mind to have the intent to commit first-degree murder. And that's why they're not charged with those crimes, right? And I think we would roughly agree with that. Like an 8-year-old can't first-degree murder someone because an 8-year-old, no offense to 8-year-olds, they don't even really know what like death and life means. They're [ __ ] of their kids, right? But we wouldn't say it's okay to eat children.

Yeah. But our our our um our attitudes towards intent and people being able to possess intent doesn't isn't a binary of we eat them or don't eat them, right? And also I would say that act I mean I would make the argument of actually those I would say that the children argument doesn't make sense. Children can possess intent. It's just whether or not we ascribe to them um the ability to have the intent such that we could charge them criminally. We still have intent more than what any animal has possibly. I mean when you're at a lower age like I would say like below the age of like one we I don't think we ascribe much intent to like toddlers or whatever you call the age before toddlers like infants or whatever. We don't ascribe much intent to them. Like if they throw something at somebody or they hit you in the face, you're just like, "Oh, the kid's being stupid. It's just a kid or it's a baby." See, in that sense, then I would just kind of default back to kind of the the empathy thing where it's just like since we're able to empathize such with a child. Um, and the necessity to eat is not there such that we would need to eat the child, then that's why we don't eat them. It doesn't have anything to do then at that point, it's really not the intent.

Yeah. But after the necessity argument, all vegans would say it's not a necessity to eat animals. We could live off of plants. No, no, but it's a It's like a it's like a supply and demand graph, right? As your empathy goes down, your necessity also goes down for the the the the amount of necessity to eat goes down for you to eat that animal, right? I don't empathize very much with cows. Defendant's opposition to plaintiff's motion grossly m mischaracterizes the nature uh mischaracterizes the nature of the relief sought the applicable legal standards and the relevant facts. Plaintiff does not seek to muzzle the defendant nor does she seek to prevent him from defending himself in court. Yeah, no [ __ ] Sherlock [ __ ] Holmes. Rather, plaintiff seeks a narrowly tailored protective order that applies equally to all trial participants. Well, because she's already gotten her [ __ ] out there, but okay. and is only intended to curb the ongoing harassment, intimidation, and misrepresentation that threatens the integrity of these proceedings and deter witness participation. C. Proposed protective order, blah blah blah. Okay. The record is clear. Multiple potential witnesses have withdrawn their willingness to testify due to fear of retaliation and doxing by defendant and his followers. There's never been any evidence of this submitted ever, but okay. Defendant has made explicit threats of violence against plaintiffs witnesses. Again, Queen Andistle are not witnesses in this case, so it has nothing to do with that at all. But we can I guess you could just lie over and over and over and over and over and over and over again in every single motion I guess you file. But okay, disparaged plaintiff. True. her witnesses. Um, kind of true, but I mean like all of them are actively and continually chatting in just Discord server. Like what do you like? These are the least secretive people ever. Her witnesses and her attorneys in repugnant terms. Get over yourself. Who the [ __ ] cares? disclosed the sealed identity of plaintiff. Her name was literally posted on her gifts and

Go when she initially, um, published it. But also this was it was I her name was used the same day she filed for a protective order. After that, I haven't done it at all, and I've removed it when they've asked. But I like how she keeps saying this over and over again. And published private communications on platforms with hundreds of thousands of viewers. Yeah, there's not this isn't illegal. There's not a law against this, but defendant claims that plaintiff continues to attack and malign by now online, but provides no evidentiary support, nor can he for this false contention.

Defendant's opposition further asserts the plaintiff's public statements include vitriolic attacks on Banell and his attorneys, but again provides no evidentiary support, nor can he for this false statement. I mean, she tweeted about the denim [ __ ] No. Do they just say that that doesn't count here? But but plaintiff requests that these unsupported and false statements by defendant be stricken from the record pursuant to rule 12F of the federal rules of civil procedure. Plaintiff also requests that the court admonish defendant's council for litigating in bad faith and/or impose sanctions pursuant to rule 11.

I see that they have it looks like they have somebody else writing these now. Um, because this one is formatted quite a bit differently than the other ones. I wonder if they hired somebody else or if one of the other lawyers are writing these now. Are you not allowed to say her username? Pixie. I can say Pixie. I'm just not supposed to use her real name. This is [ __ ] though. Like when people do these cases with protective orders because they don't want to be known or they don't want to be associated publicly with the case. Pixie loves the public association. She wants to be publicly associated. She just doesn't want to be quote-unquote doxed, which is like a child's term that you use online for not wanting people to know your name, but it shouldn't really apply here in a court term.

Retroactively looking back, I wish you would have fought the initial protective order. I don't know if there's a likelihood of success on on winning there, but maybe it would just a waste of money. If I was representing myself, I would have fought the protective order. How are you going to ask for a protective order when you've already publicized all of this online and wrote a Substack and everything else about it? It would it's just it's an exceptional use of a protective order. And if you um if you look at any of the other cases around this, like nothing is ever done like this. Like this is just [ __ ] wild.

Um, instead, even the evidence submitted by defendant shows that plaintiff's limited public updates, in contrast, have been respectful and have not disclosed confidential information, threatened any party, or deterred any participant. Rather, they seek to encourage participants. H how do I even get participants on my side of this? I mean, I don't know what why would a person not being protected help you, Destiny? Um, there's a public interest to court proceedings being public. Um, there's a public interest to people's names and reputation. Like if you're filing stuff in public court, you're making a claim. You're basically saying that I think that I've been injured in such a way that I think the state needs to intervene and grant me relief for this particular thing. And all of us have a public interest in having access to the records on that. Is why all the court filings are public. Um, protective orders and things protecting names should be exceptional and they are exceptional rather than the rule for these types of um for these types of things.

But defendant's opposition ignores the governing standard the substantial likelihood of material prejudice test set forth in *Gentile v. State Bar of Nevada*, which courts in this district routinely apply. The proposed protective order meets the standard and is the least restrictive means of protecting the judicial process. I'm not going to bother reading all the underlying cases. Every time I do, they're horrendously miscited, but I don't know if it is or isn't here. Wait, if they are saying you provide no proof of her speaking and lying, why don't just submit the tweet to the court as evidence or whatever? We probably did in the last motion, but these guys just say whatever. They just lie over and over and over again. And until judges the judge starts ruling on things. I mean, I think we're supposed to get some rulings on these motions hopefully within a week, but the big one will be what the magistrate judge recommends in regards to the um uh the uh preliminary injunction. And then hopefully we get I get approval to uh go over that transcript publicly.

Contrary to defendant's framing, the proposed protective order is not an asymmetric gag order. It explicitly applies to all trial participants, including plaintiff. Um, didn't she imply that your lawyer was a rape defender on Twitter? Wouldn't that be an example of her attacking your lawyers? Yeah, I don't remember if um Andrew included that in a briefing or not, but yeah, I think she did tweet that initially that Destiny got the lawyer who defended, you know, these guys or whatever. Are your council or you uh planning to respond to these motions? Um, no. These are there's a name for it when you have a right of reply. Where are my lawyer people at? What's it called? Like a right to reply like we've already given our response or we've already given our response to their motion and I think this is their response to our response to the motion or something. [ __ ] Let me check. Hold on. We are not entitled to file a sur-reply. Sur-reply I'm guessing is like a required response to a thing. So we don't have a right to respond to the response. Basically, you should explain why they sealed it. For laypeople, it looks like it's the court siding with them because they have reasonable arguments to seal it rather than it being standard operating procedure. Well, they haven't sealed it yet. It's just sealed until the judge makes a ruling on it. I think generally when you request things to be sealed, they'll be sealed until the judge makes a ruling because if it's open and then they make a ruling to seal it, it kind of defeats the purpose, right? But I'm pretty sure that um I I think it I think it would be exceptional if they agreed to seal that after it was already an open court and they really didn't have any good legal arguments for it.

So it explicitly applies to all trial participants including plaintiff and prohibits only that public comments commentary which disparages, threatens or intimidates parties, council or witnesses. Disparages like what I can't say like it's so crazy discloses sealed identities or confidential attorney communications you don't need in order for this it's already not okay to disclose sealed identities or confidential communications that's why the identities are sealed and that's why these communications are if they're confidential so I don't know why um I don't know why you ask for an order about that. Misrepresents legal filings or court orders. How? Like, are you allowed to be [ __ ] If you think I'm incorrect about how I'm representing something, then fine. But I mean, like, I want to protect order against misrepresenting. Like, what does that even mean? Uh, okay. But discloses sensitive personal allegations or private details of the parties or witnesses. Like all of these people are constantly talking about me in Justicle server. Like I can't say anything about any of these people ever now. And also it applies to every single person like potential witness. I don't even know what a potential witness is in this case. Apparently anybody can be a witness ever. Trump could jump onto this case I guess. Such restrictions are well within constitutional bounds. Defendant's reliance on this case and this case for his contention that the proposed order violates his First Amendment rights is misplaced. Both cases are inappropriate or in opposite uh since they involve broad restraints on the press not on trial participants. The Supreme Court and other courts of appeals have recognized a distinction between participants in the litigation and strangers to it pursuant to which gag orders on trial participants are evaluated under a less stringent standard than gag orders on the press.

Oh, cute. Are they actually trying to read through the cases now and cite them in their their motions? Am I inspiring them on stream to do their job? Good job. I'm too lazy to dig through these cases, though. *Nebraska Press* is further distinguishable because the prior restraint was struck down due to the lower court's failure to consider less restrictive means or measures. *CBN* is also distinguishable because one there was no evidence of actual or potential prejudice in the to the proceedings and two it was a white-collar crime case where the courts have found a lessening of endangered prejudice compared to cases involving lurid subject matter which carry a more significant danger of prejudice. In contrast here, one, less restrictive measures would not suffice or sufface, and two, plaintiff has presented evidence of actual and potential prejudice, and three, the lurid subject matter of this case carries a high risk of prejudice. Three, plaintiff has demonstrated substantial likelihood of material prejudice.

Defendant contends the plaintiff has not demonstrated a substantial likelihood of prejudice to the proceedings because one, this case is an early prediscovery posture, and two, plaintiff has only demonstrated speculative harm or generalized discomfort. Both of these arguments fail. First, this case is not in an early prediscovery posture. Discovery has already commenced. Written discovery requests have already been exchanged by the parties and responses are due. However, the parties agreed to wait or await the court's ruling on plaintiff's motion for a protective order governing discovery before exchanging responses and documents. I don't know if there's like a formal distinguishing thing between pre-discovery and discovery and whatever. We haven't turned over any discovery yet because we're waiting for the court to rule in some motions. So, I I I don't know. Moreover, the case law relied on by defendant in support of the argument is in opposite in *Calhoun v. Invention Submission Corp*. The defendant requested that sanctions be imposed on plaintiff and/or council for posting the allegations of the complaint on a website. Discovery had not yet commenced and no trial date is scheduled, let alone on the horizon. Here in contrast, plaintiff has not moved for sanctions but for a protective order. And two, the defendant has not just posted the allegations of the complaint, but instead has harassed and vilified plaintiff, witnesses and her counsel and threatened bodily harm to witnesses. Okay. And discovery has commenced in a trial that has been set. Nor is *Constant v. Cosby* helpful to defendant since there the court entered an order imposing limits on attorney speech.

Second, defendant's argument the plaintiff has shown only speculative harm is clearly belied by the record. As detailed in plaintiff's motion and supporting declaration. Defendant has publicly threatened to kill potential witnesses. I'd kill them if I could. I want someone to kill named witnesses. Again, Justicle and Quean are not witnesses in this case, but as long as Kiwi Farms continues to post it, I guess that's they'll continue to copy-paste it. Um, I don't again I don't know how long you can just lie about something over and over and over and over and over and over and over again. Maybe maybe this will just be the lie that they carry if they get there all the way to trial. Maybe. Who knows? Um, disclosed plaintiff's legal name in violation of the court's anonymity order. Again, this happened before the protective order came out. Since then, not disclose the person's name. Um, and clearly the plaintiff didn't really care because they withheld that like the name was in the video for months so that they could have it in a motion, you know, six months into the case, I guess. But okay. Published confidential meet and confer communications published confidential I don't even know if these communications are supposed to be considered confidential but okay and engaged in a pattern of disparagement and ridicule directed at plaintiff, her witnesses and prospective witnesses and plaintiff's counsel. I mean, plaintiff has done the same to me I mean like you've when you've made a public Substack that is unhinged and contains like a [ __ ] ton of lies in it and then you cry that I think that you're a crazy person or like this. It's just so ridiculous, but whatever.

Um, plaintiff provided specifics regarding Bunnell's vitriolic public commentary and prospective witnesses' reactions to it, where I went through all of the declarations and I think I only saw one person um who said something but it wasn't even um Yeah, I don't know where these filings are. Somebody can lick it if you if it's there somewhere, I guess. See, ECF 44, 841, and 844. I guess we can look 841 and 844. PL provided specifics regarding Bunnell's vitriolic public commentary and prospective witnesses' reaction to it. This is 841 by Jane Doe. Oh, so this is just Pixie. I'm over 18 years of age. I'm guessing a comment on your oath a personalized. This is so [ __ ] [ __ ] dude. You She's just She's still running with the with This is just hearsay. This I'm sorry. This is double hearsay. One of the individuals whose screen name was Link. This is When was this filed? I don't even remember when this was filed. um June 2nd. Oh, right before the hearing. So, her evidence of people feeling threatened by me are one of these individuals whose name was censored told me that the defendant sent the video depicting me to their sister just a few months ago. This individual and their sister as well as other individuals who had initially contacted me completely deleted their accounts after Destiny posted his video on YouTube entitled "Destiny addresses lawsuit." So keep in mind just to be aware of what this this incompetent [ __ ] [ __ ] is doing, right? Is she filed a lawsuit against me and she didn't get statements, declarations, affidavits from any of the accounts that supposedly DM'd her. Like what the [ __ ] is wrong? How [ __ ] stupid do you have to be? What? Like what are you even doing at this point? You have why would you not get a single one of these in writing? Why would you not get any names or any statements or verify that any of this information is even [ __ ] true? But then she keeps throwing it over and over and over again in all of her like hello in this video defendant further violates my privacy by publishing to his almost 1 million followers out of context private messages. The three women that provided declarations under seal in support of plaintiff's motion for preliminary injunction expressed fear of being publicly targeted or doxed. This is hearsay. Make them submit an affidavit or declaration saying it. You can't just speak for everybody. That's not how this works, little bro. You can't just say like somebody else said this. You have to they need to sign that. They need to attest to that under oath. They have to sign a thing saying that I promise this is my sworn and truth statement because maybe you're misinterpreting things or maybe they say they wouldn't said that. You I don't know why they keep doing this. I know why. It's cuz they're it's because it's malicious is the actual answer.

The three women that provided declarations under seal in support of plaintiff's motion for preliminary injunction expressed fear of being publicly targeted or doxed by defendant and/or his followers and indicated they were unwilling to participate in discovery or testify unless their identities remain confidential. For this reason, the witness declarations were filed under seal. Like that's not in any of the declarations. But besides these three witnesses, there are four additional witnesses I have contact with, but they told me that they are afraid of speaking out or testifying against the defendant because it was likely retaliation and harassment. Attached here too as exhibit A is a true and correct copy of one of these witnesses named H who has communicated to me her fear of defendant. Desi tried to repeatedly dox one of these witnesses whose screen name is blank after he publicly expressed his support for me. That's not a witness. Somebody who expressed support, he's not a witness. The potential witness will not testify to pertinent information regarding the case unless his information be protected. Blank has expressed fear of providing any further information. Active defendant publicly called for his death on the defendant's YouTube channel. Uh, wait, have I? Or were they talking about on Willie Mac's YouTube channel? I'm pretty sure that was the thing that Willie Mack published me. I don't think I ever said any of I don't remember if I did or not. I don't to be honest, but The three other potential witnesses also believe that the defendant has committed crimes against them by disclosing intimate images of them. The three other potential witnesses are your three current witnesses, but they were afraid of pursuing legal action because of how he's publicly harassed and assaulted me and anyone who has supported me, including my council. Three of their of these witnesses have expressed to me their fear uh that their physical well-being could even put at risk if they attempt to pursue justice. Like, how does this even make sense? If you file it under seal, I still get access to the name. You think I'm willing to have these people like physically attacked, but if you file it under seal, I won't do that. Like, what? Why am I Destiny in the court filings and not Stephen or something? They go back and forth because they're mentally [ __ ] Almost every individual I've communicated with expressed not only their disgust for defendant's actions, but also their reluctance to speak out publicly due to their concern and fear of defendant retaliating against them. Wow. Wasn't that statement about Dist before they were mentioned as potential witnesses in this case anyway? Yes. Yeah. It was like months ago when Willie Mack interviewed me for a [ __ ] YouTube video. Yes. And it wasn't on my channel. It was on Willie Max or whatever. Oh, this text message. I I'm sorry. I just remember this one. My bad. They did submit this. Um, I just forgot about it because this is the most obviously faked [ __ ] message I've ever seen in my entire [ __ ] life. Steven Bunnell has abused his position of power and community to gain favor and harass people in the past. I find his actions deplorable and terrifying. I will never feel comfortable being a witness in this case against Steven unless my identity is protected. I fear for my family, friends, and my current and future careers. Without protection, I am almost certain I will receive harassment and doxing from his community. Nice based. And it's the first text message they got from this person. Good one. Okay. So, those are the two things that they submitted for evidence of my of prospective witnesses being afraid. Gotcha. Wait. Surely there is some official affidavit from this person um that they should have filed instead of this weird written text message screenshot. No, because they don't have any witnesses for this case because this entire thing is [ __ ] [ __ ] and they know it's [ __ ] [ __ ] which is why all of this is like either hearsay from Pixie. Um oh it's one through four, not just because this is 81-4 to 814-4. I see. Um, it's just I don't have money for a lawyer or anything. Once he knows my name or something, I'm afraid he's going to harass me or get others to do so. And then like what Jessica doesn't even have any what the like what what is he doesn't even have any information relevant to this case. Are what is the is the claim that I'm sending him video like we're jerk buddies? Like what? It's so [ __ ] crazy. But okay, my jerk mate duo. Yeah.

Contrary to defendant's blithe contention that plaintiff failed to tie her alleged harm to any specific statements or conduct attributed to Bonell, the evidence presented it shows that defendant's actions have caused multiple prospective witnesses to refuse participation and has hindered evidence gathering and thus prejudiced these proceedings. Um, when was my first when was my first YouTube video response published? What was the date on that? Wait, I thought there was a YouTube video linked in here. Am I crazy? Is the link just not in a different color? Oh, wait. That's not my This purpose purpose. "Destiny addresses his lawsuit." This is February 20th. That text message was on January 22nd. Had I said anything publicly about this yet? How is my how are my statements in the future scaring defendants in the past? Because that text message that they cited here, first of all, this is just was not relevant to this case at all. He has no discover. There's nothing relevant. This person said that they were afraid of me on January 22nd. Had I even said anything yet about this when did Pixie drop her thing on January 20th? Like they're already afraid. Like what? Seriously? Okay. Time moves in one direction. Don't forget. Oh, she's the one that linked my YouTube video on February 20th. Okay. Um, the evidence presented has shown the defendant's actions cause multiple prospective witnesses to refuse participation and has hindered evidence gathering and thus prejudiced these proceedings because they have no evidence. So they have to evidence gather after making the public Substack and after filing the lawsuit in the hopes they're like praying that somebody comes forward with some magical piece.

Of evidence. But okay, this is precisely the kind of conduct that the Gentile standard was designed to address.

See also Shepherd v. Maxwell, defendant falsely argues that plaintiff's evidence is vague and unsubstantiated and relied on unnamed and/or yet unidentified witnesses. This is true. In fact, plaintiff's declaration and supporting evidence show that she specifically identified four potential witnesses that have communicated their reluctance to participate due to their fear of defendants' doxing and vicious attacks. ECF 85.

What is even um um I'm just curious. I should have um I should have unredacted versions of these, right? Um, is that your fault if they are afraid of you? Don't they need to show actual proof that something happened? They testified kind of. Yeah, it has to be it can't be generalized. It has to be um it has to be like specific and traceable or some [ __ ] Okay. Wait, what are these? Hold on. Give me a sec. I'm sorry. Wait, not this. They sent me what? They they sent the versions that they sent me were redacted. So, I don't even know personally who these What the [ __ ] Seriously, these are I have the same document. Okay. So, there are people who are afraid of me and I don't even know who. Okay. Based absolutely based. Oh, this image is redacted. So, I don't know that one. This is redacted. I don't know that one. Oh, and that message is red. Cool. All right. Cool. That's good. Based. Okay. So, I don't know. I have no further information. I wouldn't be able to tell you guys publicly. It'd be nice to know for my own case. Um, so I could like defend myself, but that's cool. That's fine. I don't have to know any of it, I guess.

In fact, L declaration putting evidence to show that she specifically identified four potential witnesses. What does that even mean? That have communicated their reluctance to participate due to their fear of defendants' doxing and vicious attacks. The names of these witnesses were redacted in the declaration. They haven't submitted an emotional following. She was submitted. Um, moreover, the three witnesses who have agreed to testify and provided declarations would only do so under seal due to their fear of defendants' retaliation. See, but they leaked basically the names for all these people anyway. So, a good one. Um, also I read all of these declarations. I think only one of them mentioned anything about being afraid um or wanting to remain anonymous. The declaration of Brooke, she doesn't say anything about being afraid or wanting to be anonymous. That was the first one that was submitted. Um, the declaration of AbbyMC, she says it she doesn't want her real name revealed, yet they leaked the and they keep referring to her over and over again as Abby MC, which is [ __ ] stupid.

Um, for documentary 494, um, they don't they're not even a witness to this case. I don't even know what the [ __ ] this person is doing here. Um, like the like none of the witnesses are even relevant to this case. Like here's an anonymous witness. I am over the age or I'm above the age of 18 and competent testimony. I have personal knowledge of matters are in blah blah. Okay. Beginning of May 25th, 2024, I began exchanging messages with the defendant Steven Gabanell on Instagram on Discord where I engaged as a fan. There after beginning May uh late May 2024, our conversations progressed and became more personal. We began exchanging private sexual content with one another and Destiny shared graphic sexual content himself alone as well as graphic content depicting others himself and other individuals engaging in sexual acts. Destiny shared some of these videos with me directly via Discord messages but the majority of them were shared through a Google Drive link which he sent me via Discord for the first time on or about June 2024. The graphic sexual content that he shared with me was mostly digital videos although some were digital photographs as well. I ceased contact with Destiny on or about November 5th, 2024. I subsequently became aware of the allegations that have been online leaks of Destiny engaging in sexual acts with individuals on or about January 21st, 2025. I became aware of Jane Doe's post on Twitter where she alleged in part that Destiny had to share the videos of them engaging in sexual acts without her consent. Shortly thereafter, I reached out to Jane Doe on Twitter and informed her that I was concerned that Destiny had been sharing private sexual content without consent, stating in part that quote, "Back in spring/summer, he had sent me videos with other girls. I assumed that he had consent for these, but I realized he likely didn't." Although I had access to the message between Destiny and myself at this point, sometime afterward, I discovered that I deleted the message between him and him and Discord. Uh, and subsequently discovered that I no longer access the Google Drive containing the graphic sexual content, which we deleted. This is like what is this? this like this person isn't even claiming that they got anything from me of Pixie, number one. And then number two, they don't even have any context on like, oh, well, I think these other videos weren't okay. Like, what even is this? This is it's not even relevant to this case. Um, let's see. That's one. And then this is their other quote-unquote witness.

On about April 2022, I reached out to the defense team with Kon the second via Twitter. Shortly thereafter, we got to arrange together in blank where we began a sexual relationship. Thereafter, Destiny and I remained in contact as being friendly with his wife at the time, Molina at some point as he asked me if I was comfortable with him sharing videos or pictures of sexual content himself as well as himself and his wife. I told him that I did consent to him sharing these videos um with me. Thereafter, we began sharing pictures and videos of sexual content with one another. Mostly him alone, although at least one of these or at least one of these videos included himself and his wife. On or about mid-to-late April 23, uh Destiny invited me to blank where he was staying briefly while at blank. Destiny recorded himself when I engaged in sexual acts; recordings made with my consent and I authorized him to share the recordings with his wife exclusively. I did not authorize Destiny to share the recordings with anyone else or otherwise make them public. Thereafter, I continued to connect with Destiny online. In late November 2024, I was asked by multiple individuals while on Discord to inform me that a video of Destiny and myself was believed online. After confirming this was the case of Destiny um I don't I don't know if I'm allowed to speak to our well I'm not revealing who this is. So who told me that he was sorry that any videos involving myself had leaked because of him. Destiny also told me that he only shared this content with a single individual who went by the screen name Rose. I don't believe that's true. Uh following this conversation, I received a message from multiple women on Discord and Twitter who had been in contact with Destiny who told me that Destiny had shared with them sexual content depicting myself as well as others. Sometime after the November 29th leaks, I discovered that Destiny deleted messages between himself and I related to the foregoing. So the ironic thing is, and I can bring this up right now, but I I won't because I don't want to reveal what it is. They deleted their messages with me, which is funny because we had talked after this and we're still friends after this. And then I looked at my Discord one day and I noticed, oh [ __ ] they've deleted all of their messages with me. But I also found out that they were hanging out in a certain just Discord. But also, regardless of all of that, this has also has nothing to do with this case. What? Like what is what why is this even here? Like this person has nothing related to the actual complaint following Pixie. This person's not making allegations. Like there's literally no point for this even being here. It's they have so much random [ __ ]

So, the fact that they're trying to say that, "Oh my god, these witnesses are intimidated." They're not even witnesses. These aren't witnesses to this case. These are like literally um these are like random statements that you've collected from people to just throw on that literally have nothing to do with any of this. Like I I don't even know what I can respond to for these. Like, it's not even the subject matter here. But defendant's attempts to ignore or downplay the harm he is causing falls flat in the face of the overwhelming evidence presented. Defendant declared the following about two potential witnesses. Potential witnesses. That's why people like Jessica and Queen if I could put their [ __ ] balls in a vice and crush them and then feed it to them and then slice their arm and kill them. See blank at minute 5642. When did I even do this interview? interview. I feel like this interview was done in like January or February. This um does Willie say one, this interview was done a long time ago. Two, this isn't even published on my channel. Three, these people are not parties to this case. These people are not witnesses. They have nothing to do with any of this and none of my commentary about the media has anything to do with this case. So, it's like it's so [ __ ] stupid. Defendant has failed to refute the overwhelming evidence consisting of his vitriolic and threatening public commentary, its impact on witness participation and his actual and ongoing harm to these proceedings. To allow defendant to continue with his unfettered public commentary will jeopardize the integrity of these proceedings and impair plaintiff's right to present witnesses. Saying all of this while is saying all of this while while even temporarily sealing the transcript where we spoke in front of a [ __ ] judge is the ultimate in cuckoldry in spineless weaponization of the legal system and in weaponizing the of the white woman status to seal the transcript where we're both under oath and we have to answer honestly in front of a [ __ ] judge. And it's not just the unhinged uh deranged and incoherent ramblings of a of a schizo lunatic that can apply to either plaintiff or her counsel. Like it's actually it's it's subhuman behavior. Like The protective order is the least of means. Uh defendants contends that vi I don't know what that means. Good job. Voardier. Voardier. A preliminary examination of a witness or a juror by a judge or counsel. Wait, wasn't this a public hearing? How can they make it private? It was public. I don't think they can make it private. Hopefully, the judge should rule against that, but we have to wait for the judge to rule on it. Has it voir that's what he said right vadier vadier contends that voadir jury instructions or confidentiality orders are sufficient alternatives; they are not. This case is still in the pre-trial phase and voadir does nothing to address ongoing harm to witnesses, witness intimidation and/or the risk of future disclosures of confidential material. The proposed order is narrowly drawn, addresses only the harmful conduct already documented and preserves all rights to file pleadings and argue the case in court. Moreover, although protective orders governing discovery are standard in cases such as the instant one involving sensitive personal information, not only did defendant refuse to cooperate with plaintiff's efforts towards a stipulated confidentiality agreement, but he has actually opposed plaintiff's motion for a protective order governing discovery. And although that protective order would serve to protect confidential sensitive information of the parties, it would not prevent the defendant from continuing his public doxing and threatening and false commentary.

Defendant contends that a proposed protective order may restrict his right to defend himself. The narrowly tailored order does no such thing unless his right to defense involves attacking and threatening plaintiff, witnesses, and counsel. It does not. The First Amendment does not protect speech that interferes with the fair administration of justice. The fair administration of justice. My god.

Defendants' attempts to construe plaintiff's motion as nothing more than an attempt to restrict public access to this court is nonsensical. The pleadings are available to the public and nothing in the proposed order seeks to alter public access. That's literally what a seal does or unless they're talking about the that's what a protective order if they're if they're filing to protect names and stuff. That's literally what it does is to keep stuff off the public record. Um, but okay. Say the judge sees through this [ __ ] Is it possible for the plaintiff forced to do like a full public retraction or something? Uh, no. They would never. I would have to like counter seal or something like that or counter sue or something. But the applicable precedent supports the entry of the narrowly tailored proposed protective order. Defendant fails to distinguish the controlling precedent relied on by plaintiff in her motion. Indeed, the opposition fails to even address or attempt to distinguish the primary case relied on by plaintiff, Hernandez, in which the district of Florida imposed restrictions on trial participant speech after finding it likely to prejudice and no less restrictive means. Defendants' opposition fails to address the critical vested commentary and targeted speech that threatens the integrity of judicial proceedings. Do you get the vibe that does lawyer hates you personally because she's seen all your negative comments? Um, I think it's I think they do because it's a personal friend. That's what I I'm pretty sure it's a personal family friend. Um particularly through the intimidation or silencing of witnesses, restrictions on extrajudicial statements by trial participants are both lawful and necessary. The evidence submitted showing the defendant has publicly threatened, disparaged, and attempted to dox potential, specifically identifiable witnesses demonstrates precisely the kind of conduct these authorities contemplate. The Southern District of Florida recognized in Hernandez, um, when witness participation is chilled by public attacks, courts may impose narrowly tailored speech restrictions as the least restrictive means of safeguarding the proceedings. This motion does not seek to silence one party or prevent any valid defense. It is about protecting vulnerable witnesses from intimidation and ensuring that testimony may proceed free from fear or retaliation.

Defendant misleadingly claims that this is a low-profile civil dispute, opposing thing page 11. It is not there. I wonder what this was in the context of I mean it's a civil case. It's not like a huge corporate litigation thing and it's not a criminal case, but there have been numerous press releases and articles about it and hundreds of thousands of people tune into defendants' streaming platforms to hear his distorted version of the proceedings and allegations as I just read the court documents. But okay, and to listen to and encourage with financial remuneration his abuse of the plaintiff, her witnesses, and her counsel. They keep bringing this up over and over and over again despite the fact that I've lost money on this. And they know that too because that was also part of our hearing, which is probably another reason why they want to keep it sealed. I think this woman could have had law school paid for but went this route instead. I think she already took the LSAT so she probably took it and got like a [ __ ] 70 on it and was like, "Fuck me. We'll just play lawyer instead." This is not the run-of-the-mill civil dispute, but rather a high-profile dispute with lurid content and a trial participant, the defendant, who has his own streaming platforms with almost 1 million followers. This scenario only exacerbates the high risk of prejudice to these proceedings due to defendants' threatening, harassing, and false commentary. Plaintiff's limited public comments do not warrant denial of the order. Defendant argues that plaintiff's own public statements undermine her request. This is false. Equivalence. Plaintiff's posts consist of announcements of procedural rulings. For example, sealing of witness identities. A fundraising effort. Defendant should certainly not object to plaintiff's GoFundMe page. It's a give and go page. Got him. Since he has been profiting immensely from this case by streaming on a regular basis about it. Uh my lawyer fees are up to about $200,000 so far. I have not made that much money um talking about this case. Uh not to mention uh canceled shows, reputational harm that will likely never go away. Um and everything else involved in this, but that's cute to say this over and over again. They really, really, really like to run with this argument. This profit revenue is evidenced by the number of views on his videos about the case and the number of comments and questions. For example, streamers such as Defendant receive revenue from their YouTube channels based on memberships, AdSense revenue. Streamer gets paid based on the number of users viewing ads and super chats. User pays to have his or her message highlighted in the live chat during a stream. The more money is paid, the more likely the stream will read the message aloud or respond to the question. Um, a fundraising effort in general calls for information relevant to her case or witnesses. Again, I'm sorry, little bro, but if you want to be a big boy or big girl and you want to be an adult and you want to file a court case, then you should file the case with your affidavit and everything in hand. If you're filing a case with nothing on on pure [ __ ] lies and copium, which is what she has done, and she has she knows that she's done that. Um, and then you're praying to God that after attacking my reputation as hard as you can, after going after everything I have as hard as you can, praying that somebody comes forward to substantiate your [ __ ] case. That's that's on you for being a [ __ ] [ __ ] Sorry. CCF 992 to 95. And in stark contrast to defendant, none of plaintiff's posts involve threats, harassment, vilification, saying that I'm lying about her age over and over again, saying that she was 19, saying that I purposefully wanted uh my sexual content to be leaked and spread all over the [ __ ] internet. All of that, none of that was vilification. Seriously, exposure of sealed identities, identity. And again, it wasn't sealed yet. It was the same day but or publication of confidential materials. I don't know what they're even referring to there. Plaintiff has not doxed, intimidated or mocked any party or witness. There is no evidence the plaintiff's limited posts have deterred witness participation or jeopardized trial fairness. While there is ample evidence the defendants' posts have done so. See above for their declarations of people that aren't even relevant to this case, based. Um, defendant distorts the request for relief by arguing that the protective order would allow plaintiff to broadcast her message while silencing him. But it is patently clear that the request for relief would apply equally to both plaintiff and defendant and seeks only to silence threatening, harassing and false commentary. See ECF 845. I forget. Did their thing allow them for her to keep her stupid [ __ ] GoFundMe up, her give seno up? Is it just me or does this feel like it hinges entirely on the premise that you leaked everything to Kiwi Farms intentionally despite you being the one most? Yes, it does. I think that's one of the overarching narratives that kind of got destroyed at the hearing, which I think is one of the reasons why another one of the reasons why they wanted that transcript sealed. And it was funny. This is one of the things that I was like happy about is I could see the um cuz the the judge kept asking questions where he's like, "Wait, so he published that to Kiwi Farms and then she like, "Well, no, someone else." I was like, "Oh, okay." Or when she was talking about when I found out that she'd sent all of our videos to her um ex. And the judge is like, "Wait, he sent all of your guys' videos to your

ex-boyfriend." And then she's like, "No, no, no. I sent our videos to my ex." I was like, "Oh." Like, like he was at like I could see the lights turning on on the judge, and he was like, "Wait, what?" Or like, this is wait, really? Um, but hopefully we can read the transcript soon.

Publicizes or repeats any confidential settlement discussions or communications, which are federal rule superior 408. You're going to have—Wait, is this even a real protective order? And part of it is—misrepresents or mischaracterizes the content of legal filings? What rule for compromise offers and negotiations? Prohibited uses. Evidence of the following is not admissible on behalf of either party, of any party, either to prove or disprove the validity or amount of a disputed claim or to impeach by a prior inconsistent statement or condition. Not like evidence like you can't submit evidence to prove or disprove the validity or amount of a disputed claim based on the settlement discussions, as with evidence of subsequent remedial measures dealt with in rule 407. Inclusion may be based on two grounds. One, the evidence is irrelevant since the offer may be motivated by a desire for peace rather than from any concession of weakness positions. Publicly identifies the plaintiff or witnesses whose declarations have already have been filed under seal or speculates about the identity of witnesses or potential witnesses, particularly in derogatory, demeaning, or inflammatory terms. So then the entire trial would basically be putting Abby on the stand and then having her testify. Um, but she must agree to be deposed and answer any questions before uh MSJ. Oh, motion for some. Oh, maybe that's true. Maybe if she refuses to be deposed, then maybe it gets tossed. I guess what reason—um—what would be the reason for you to not show publicly all the DMs with this person? For months, the defendant has been gloating on his platforms to his hundreds of thousands of followers that despite his heinous acts, he will not be held accountable because he allegedly shared the video prior to the effective date of Cardi. No, I have not said that I think anything wrong happened or that anything was done, you know, non-consensually, whatever. Uh, that's a—that would be an argument that we could have uh if they had subject matter jurisdiction. But the first argument we're going with is—of course—is you're trying a case that you don't even have the authority to file in federal court. You chose to file in federal court, and you chose to file under the statute, and you chose to deliberately lie in the filings. One, claiming that you had evidence from people that didn't exist or that you hadn't gathered evidence from, and two, by lying and misstating the date of a submitted text message in order to bring it in so you could file this in public court in federal court so that you could have your fun day parading around on the internet like you're—like you meant something. Um, so that's on you. Sorry. Indeed, today defendants entire defense has hung its hat on this alleged lack of subject matter jurisdiction. That's wrong, and that's a lie. But I can't read the court transcript where we talked about this in front of the judge. So I guess you got me there for now. But despite defendants harassing and threatening commentary intended—intended to prevent witnesses from coming forward on plaintiff's behalf, a brave witness did come forward and provided a declaration evidencing that defendant shared the video with her after the effective date of Cardi, thereby defeating defendants's only defense. Okay, that's not my only—without the IBMC testimony and evidence. Ever—there are strong legal grounds for finding subject matter jurisdiction under—under inia—the ongoing distribution doctrine. So there's another Kiwi Farms argument where they're saying—well, if you send a link to a thing—technically you're always continually and forever sending it. But again, my counter argument there is that means that every single thing you ever send ever is always being continually forever sent. That would be true of every single digital platform ever—which is—which is [ __ ] stupid. There's—I've never seen a court case ever that uses this standard to—to determine ongoing distribution, but they're welcome to cite one if they can find it. Although actually, I think also—I think in the hearing—I think they admitted that they had zero case law to back that claim up as well. Um, defendants's opposition relies on false and misleading statements. A mischaracterization of the evidence and inapplicable case law in its futile attempt to strike the corroborating evidence. The very premise of the opposition is false. The evidentiary hearing on plaintiff's motion already occurred. Now, on the eve of the court issuing a ruling on her motion, plaintiff seeks to submit new and untimely evidence in support of her motion, depriving Banell of an opportunity to respond or to challenge the declarant in open court. The actual facts are that one, Adam's decoration was submitted on May 2nd, 2025, in support of plaintiff's reply to opposition. Two, motion for a preliminary uh injunction. It doesn't even match the—That doesn't even match what she—the additional set that she filed. She said that I told my friend that I sent me another video of him and another woman that I—that just another person. She—So, she doesn't even accurately summarize. I—I don't even—I'm not gonna say anything or whatever. Maybe the—like her—her aid here doesn't even match the—the text messages that she submitted, but okay. Um, the specifically referenced and quoted a text chat thread. I don't see any quotations here or quote marks unless I'm missing something, but okay. Maybe quoted means something different to them. The evidence is not new, but rather is evidence corroborating ABMC's declaration in the form of a screenshot of the referenced and precisely quoted text chat thread. The evidence was submitted before the June 3rd preliminary injunction. I like how they don't put the date that they submitted this evidence, but they do put the date they submitted her original declaration. The June 3rd preliminary injunction hearing. And then number two, her declaration doesn't even match her own text thread here because she says on or about November 3rd, I messaged a friend of mine and told him that Destiny had sent me the abovementioned sexually explicit video of himself and another woman and that I had recognized the woman as the streamer Pixie. I also told my friend that Destiny had sent me another video of him and another woman that I recognized as the streamer with a screen named Cherry. I was able to recognize Cherry just by her voice and the uh—since the video was a black screen with audio of other social interactions. I retained my—in my possession—to copy them. But that's not even really what she said here. She said that I had sent her tapes uh of Cherry and Pixie and that I sent her something different this time. So her own declaration doesn't really match her—the submitted text message here, the two messages that we see with no other context around it or anything else. I have no idea who these are—to what this is in reference to. And then their summary, their summary doesn't match their newly submitted evidence, nor does it even match her declaration. Okay, sorry. Anyway, this is [ __ ] [ __ ] but whatever. The evidence is not new, but rather evidence corroborating ABMC's declaration. The former screenshot blah blah. The evidence submitted before the June 3rd preliminary injection hearing in two and five. Bon could have subpoenaed Abby to testify at the hearing, but he did not, thereby waving any objective—or—I think we've tried to subpoena her, but we can't get a hold of her. Like the—they're not accepting service on her behalf, and we can't find her anywhere right now. So, okay. The evidence at issue is not new and was timely submitted. Defendant mischaracterizes

The corroborating evidence submitted as a new and untimely. In reality, the text message plaintiff seeks to submit was explicitly referenced in paragraph 7 of the declaration, but it wasn't explicitly referenced. There are no quotes. There is no quotation mark here for anything. This is a, at best, it's a summary of this message. It doesn't even match the content one to one of the message. And again, we're in a court case, so it's kind of important that you're being specific with your words. So whatever, which is filed on May 3rd, 2025, well before the evidentiary hearing held on June 3rd. The evidence is therefore not a belated submission, but rather documentation corroborating a declaration already in the record.

Courts routinely allow such corroborative exhibits, especially where they support previously submitted declarations and relate directly to evidentiary matters under review. Unlike in Butler versus Garland, plaintiff is not attempting to reopen the evidentiary record or offer post-hearing supplemental declarations. Instead, plaintiff merely filed corroborate. They keep calling it corroborating when it but whatever. Uh, material that reinforces previously submitted evidence already before the court. All filed prior to the hearing, the day before the hearing. Defendants' reliance on Butler's misplaced and said has no relevance here's declarations and cribbended prior to the hearing.

Ironically, on May 30th, defendant objected to ABMC's assertion in her declaration that the defendant sent her the video because she provided no support for this baseless contention and failed to attach any exhibits reflecting the alleged transmission of the video. In response, plaintiffs submitted the corroborating evidence of her text message. Why wasn't that included with the original filing? Number one, and number two, there's still nothing that has to do with uh transmitting any videos to her.

Defendant further argues that because plaintiff had notice of a jurisdictional challenge, the evidence had to have been presented at the hearing or else risk, risk waving the right to present such evidence. This, of course, is nonsensical because the court never said it would only consider evidence presented at the hearing. The briefs and supporting evidence submitted prior to the hearing are also part of the preliminary injunction record. Um, also neither of the cases defendants' connection contentions that the evidence is new or at least defendants' evidentiary objections lack merit. Um, defendant argues that the corroding text message is inadmissible hearsay and unauthenticated. However, such evidentiary objections are premature and misapplied in this context. The court may consider hearsay in preliminary injunction proceedings, particularly when it supports testimony already presented via declaration. Preliminary injunctions are customarily granted on the basis of procedures that are less formal in evidence, um, that is less complete than in a trial on the merits.

Well, um, all well-pleaded allegations in the moving party's complaint and uncontroverted affidavit filed in support of the preliminary injunction motion are taken as true. Uncontroverted, meaning we don't contest them. No. Isn't that what uncontroverted means here? Furthermore, in reviewing a preliminary injunction motion, a district court may rely on affidavit here materials which would not be admissible evidence for a permanent injunction if the evidence is appropriate given the character and objectives of the injunctive proceeding. Did the magister judge say anything in the hearing about the fact that Jane Doe submitted these exhibits on the day before the hearing? No, we brought it a couple of times, but they kind of stayed away from the um they they didn't really touch much on the ABMC stuff. The it's um, furthermore, in reviewing a preliminary injunction motion a district court may rely the exhibit is consistent with ABMC's declaration and includes metadata and contextual cues sufficient to support its probative value. The text message in November 3rd, 2023 directly corroborates paragraph 7 of the declaration the defendant transmitted a sexually explicit video of plaintiff to her. How does that cor the date corroborates that I sent them a video? In what world does every okay defendant's claim that this message lacks probative value is contradicted by his own recognition that it supports plaintiff's jurisdictional arguments under the Cardi statute.

Defendant has failed to provide to present any valid reason for the court to disregard or strike the declaration or the corroborating evidence. ABMC's decoration and the correcting text message are properly before the court for purposes of the preliminary injunction determination. ABMC's non-testimony at hearing does not warrant exclusion. Once again, defendant is litigating in bad faith by deliberately distorting facts. Defendant asserts that Abby failed to appear to testify at the hearing and that ABMC refused to appear or testify at the preliminary hearing. But defendant knows that neither he nor plaintiff requested ABMC to testify and there's no evidence to support his spurious assertion that ABMC refused or failed to appear. Defendant also deliberately attempts to mislead the court by stating plaintiff's counsel refused to accept service of a subpoena on her behalf. ABMC has thus far avoided personal service. Defendant did not provide any evidence in support of these spurious assertions, nor can he. This is because the referenced request was on May 15, 2025 for a subpoena to produce documents, not for ABMC to testify at the hearing. Moreover, plaintiff's counsel never refused to accept service. Instead, less than 24 hours later and before counsel could respond, defendant's counsel said he would proceed to serve himself. What? And then they what? Didn't respond to it? Defendant has not provided any evidence of attempts to serve ABMC. And there's certainly no evidence she's avoiding service. How do you have evidence that somebody's avoiding service? What? How do you even do that? Um, I don't think I can't like publish emails or whatever, but okay. Records of dates and times you attempted to serve. Oh, maybe this maybe if they use a service provider. I wish they might have. Maybe that'll show up in another filing. I guess plaintiff doesn't have no obligation to call every declarant as a witness for the hearing. And the record is clear. The defendant did not seek to call ABMC either. Defendant chose not to subpoena or depose ABMC in advance despite having notice of her identity and the substance of her declaration a full month prior to the hearing. The court's order scheduling the hearing did not state that all witnesses needed to testify in person or that the declarations and other evidence submitted would not be considered. That is true. She didn't need to be there. That is true. But you would imagine that you would want your solo witness that is holding your subject matter jurisdiction to be there. You would imagine that. But who knows? Who cares? Courts do not require personal testimony from every declarant where their written declarations putting evidence have been timely submitted. Technically, I don't even think I don't even know if either of us needed to be there. I think technically we both could have skipped it, but I don't know if anybody's required to be at that hearing. I'm just I'm not sure. I'm not 100% strong.

Although affidavits are ordinarily inadmissible at trial, they are fully admissible in preliminary injunction proceedings. Defendant's argument that uh he was denied the opportunity to cross-examine ABMC is baseless. Defendant had over a month's notice of ABMC's declaration and its contents, but failed to issue a subpoena, notice a deposition, or otherwise secure her attendance at the hearing. The corroborating evidence of the text message presented nothing um presented nothing not already in the declaration and thus does not change the fact that if a month's notice plaintiff was under no obligation to call every declarant and defendant's strategic choice not to compel ABMC's testimony constitutes a waiver of any objection to the court's consideration of her declaration or the corroborating text message. Did not object contemporaneously nor did he move to strike the declaration; his silence and inaction constitutes waiver of cannot remain passive and then claim unfairness when the record closes.

As a final matter, plaintiff notes that the defendant had not objected to that portion of the motion requesting that the unredacted version of the exhibit be filed under seal. The exhibit plaintiff seeks to submit is not new evidence, but it's corrective. Okay. Jesus Christ. uh, you kind of skip the last part. What does that mean? What does what mean? What last part? The last part was just a conclusion or summary of [ __ ]. Why is all this [ __ ] so slow to have anything happen? It's court. It takes a while. This is just a summary of everything that was said. Did you reach to subpoena her? Yeah, we've been trying to, but initially they said that they were representing her to sue me and then nothing came of that. And I think we requested um to do something through her lawyer, but then they said that they're no longer they don't represent her, so they can't accept or I don't know. I don't know if they said specifically they don't represent her. They said that they can't accept service on her behalf. And then um apparently we're trying to serve her, but we can't find anywhere to serve her for documents. Um, um, Destiny, chances of it getting unsealed. Uh, it should be unsealed. It should be. Um, we just have to wait for the judge to rule on it. I I my understanding is there's like no basis and no world where that actually happens where they where they would where the judge would allow a public hearing to retroactively be sealed. Bibi and I just went through hell together fighting a very tough and brilliant longtime enemy of Israel, Iran. And Bibi of Israel, Iran, and Bibi could not have been better, sharper, or stronger in his love for the incredible Holy Land. It was like two weeks of some bombing runs, okay? Anybody else would have suffered losses, embarrassment, and chaos. Bibi Netanyahu was a warrior like perhaps no other warrior in the history of Israel. And the result was something that nobody thought was possible: a complete elimination of potentially one of the biggest and most powerful nuclear weapons anywhere in the world. And it was going to happen soon. We were fighting literally for the survival of Israel. I love how he capitalizes random words like he's got schizophrenia. Despite all of this, I just learned that Bibi has been summoned to court on Monday for the continuation of this long-running—he has been going through this horror show since May of 2020. Unheard of. But a politically motivated case concerning cigars, a Bugs Bunny doll, and numerous other unfair charges in order to do him great harm.
